Was the judgement for the whole amount due under the contract (ie not just for late payment of claims?)

Yes, it was for the whole amount.

One of my sisters has got the judgement accepted for whole amount of £600.

The other sister has got also the judgement accepted for the whole remaining amount of £277.

Both of them have around 3 more claims to do with TMO.

Wow! This is great news - so if MO default on ONE payment then you can claim ALL of the outstanding cashbacks in one go....I have interpreted that correctly have I?
  • I Have just filed for the full amount (£461) against TMO, I put the defendant as Mobile matters (UK)Ltd t/a 'The mobile outlet' How long do I have to wait or should I keep checking MCOL to see if I can apply for judgement?
(Sorry for extending the post and asking possibly the same questions that has been asked before but this post if HUGE:eek:

So to answer your question about sending in future claims, there is a reason why she should (until she has received full settlement from them - at which time there is no need to send in any more claims).

In the SCC there is still the opportunity for TMO to apply to have the judgement struck out (ie. to successfully appeal), and should that unlikely thing happen and you haven't correctly submitted a claim they would be able to reject it. So she should continue with the exercise till she actually gets the money out of them.

Did you read the claimants guide? It explains everything about a MCOL.
  • Please can someone explains what happens after a court case is successfully won against them and a warrant of execution is applied for.
Does the claimant have to then pay for bailiffs?

I have sent a letter before action and am prepared to start the MCOL process but don't want to throw good money after bad in case the company stops trading.

I had one last attempt at phoning them today as they accepted my claim back in October but when they ran out of excuses they played their nasty trick of saying my voice was breaking up and then hung up on me :(

  • Does anyone know how long it takes TMO to get paid commission from the network providers?
