o2 will allow you to quit, but will charge an early termination fee (which is the equivalent of the monthly line rental you would have paid had you stayed for the full minimum period).

I have sent in my final claim last week so I am thinking of waiting until the 28 days have elapsed before going over for the full 3 claims they owe me.
What do others think?
If the plan works, then you will get your money quicker this way than via MCOL, and if they are on the way out you won't have paid out for court fees in vain.
There is the possibility that they realise what is going on, (customers paying them visits to get a cheque), and they take "evasive action" (move out, lock doors, employ security etc) before you pay your own visit.
In your decision making, add in the £55 it looks like everyone now has to spend applying for a warrant to get their money after a successful MCOL, which would be in jeopardy if they go to the wall before the bailiff gets round to you.0 -
I have a 12-month cash back offer. After having read the T&C's, I noticed one clause "To get your cash back, you need have paid your phone bill on time by Direct Debit by the date specified on the bill".

If you took out your contract after 31st July 2007 then this is an unreasonable requirement under the Code of Practice signed by all the major network operators. Therefore, according to Trading Standards you can ignore it, along with sending original copies of the bills and having the get the stuff to them in less than 60 days. If they ask why then you cite that Code of Practice, which it is the network operators job to ensure is upheld.
That said, there is no point taking risks for the sake of it, but if for example you hadn't complied with one of those then don't worry because it is deemed an unreasonable requirement anyway.

I would go and visit them in person but as my claim is only for the first instalment it does not make sense to travel up from London. I haven't even got my referral money out of quidco!!!
I have done the mcol for this instalment but I really can't see myself ever getting the other instalments paid as I think they will be long gone by then.0 -
If you read the thread you will see that you could have claimed via MCOL for the full 12 months cashback, not just the late payment of the first instalment.0

For anyone going through MCOL, I put in a claim against them late August, hearing is in the next week finally.
In fairness, your 5 month wait for a hearing is down to extraordinary circs, which people will know about if they have read the thread.
It shouldn't put anyone off who has decided to try MCOL, as hearings (if necessary) are normally much quicker.0 -
Hi all,
I've been today to the unit at Bradford Football ground to collect my owed cashbacks. I don't know if the cheques will bounce.................... I hope not. I was told they're not issuing cashback cheques at the minute................... so the only way to get your money I suggest is to pay them a visit. I'll let you know when and if the cheques clear. I was owed just short of £600 for outstanding cashbacks.

I was interested to know more about sec79s and anyone elses experiences on calling at MO offices in Bradford.
They've stalled on paying out on my last 3 cashbacks and before I'm forced to go down the MCOL route, I thought I'd go and visit them as I'm fortunate to live not too far away in S. Yorks.
Anyone who did go:
At what stage did you go to call at their offices - late payment / after court case / instead of debt collectors etc?
Was this arranged beforehand or did you call cold?
Did they take much persuasion and how willing were they to deal with you?
What sort of leverage did you use on them or did they try anything evasive?
Any other tips or advice no matter how small would be much appreciated.
Once I've been I'll report back and let you know how it all went.

Having read and reread 99 pages there are a few viewpoints on this. As I understand it according to my terms and conditions (dated June 07) they are contracted to make 5 equal payments if I jump through the right hoops. If they have delayed the first payment how does this mean I am entitled to all 5 payments? I understand if they had refused my first payment I would then be entitled to claim for the 5 payments because in effect they have refused to pay all 5 by refusing one.
It does not say in the Ts & Cs that if they fail to pay the first instalment on time that I am entitled to claim the remaining payments in one lump sum. (I only wish it did!)
As yet they have not refused to pay but have not entered into any correspondence.0
