i've got 3 contracts with them, for all i've had 2 go through MCOL, for 1 i've entered judgement & the others have just been issued. Is it still worthwhile paying them a visit or will they just ignore my request because i've already gone through MCOL? any suggestions?
  • Kitster,

In some respects it's good as you can refer to it in your MCOL and I suppose you don't end up repeating yourself, it's clear to see why you are taking legal action.
I didn't do it, nobody saw me do it, you can't prove a thing! ;)

Here is my (rather involved) LBA..
LETTER BEFORE ACTION DUE TO FAILED CASHBACK PAYMENTS

....................I believe that it is fair to ask for the full amount owed because as per your own stipulations if I would have been a single day late in sending cashback claims to yourselves then your terms state that I would lose my claim for all 12 months – it is only right that these rules apply both ways ...............

If you read through the thread you will see that this is not the argument that has been used to successfully win judgements for the whole amount due under the contract.

In fact you agreed to the clause that should you be late in claiming from them they could close the file and not pay you out.

Read up on this before filling out your MCOL if you intend claiming the whole amount without getting any other advice.

thx..letter has just been posted so cant change wording on it - but may just mcol for the one cashback, or even if i file for the whole amount they should consider getting me at least the one cashaback i am owed i hope.

At 1.17pm you posted your draft letter asking for our comments and suggestions, yet it seems you have posted it off as drafted in less than an hour since requesting this help, meaning that those who have taken the time to try and help you have in fact wasted that time!

    ******************************************

If you read through the thread you will find the necessary info on how to correctly claim the whole amount outstanding via the court.

I am trying to write an lba, and need a bit of help!

Where would I find my customer number and order number? It doesn't seem to be on any of the letters or emails I have. What should I do if I don' have them?

    Thanks!
