To suggest that we should be also making a contribution to Bott for having done some hard and challenging legal work is disingenuous and a specious argument.

Exactly. Disingenuous and specious. As well as silly.;)

What a silly response.....fd1972uk is handing 30% to Bott &Co and has a right to question their delay in progressing his claim.

It's not silly at all. I agree with you that anyone who engages a NWNF lawyer has every right to ask them questions: after all, you're basically paying them to work for you. I have no argument with that.

But your point, unless I misunderstood it, was completely different: that people who take their case on themselves and benefit from the Huzar judgement should pay Bott 30%. Having jumped through all the hoops myself, I have a lot of respect for the people who invest the time and energy to take on the airlines themselves (as, indeed, do the people at Bott).

But I'm not going to argue. We are, after all, on the same side.

Exactly, Skid marks has made some very valuable posts, that have helped me in the past, that's why I put a bit of effort into a sensible reply.

Thanks for all your posts, but since the question was asked of me, I've answered and we can move on.

I'm still annoyed that your judge was so hopelessly wrong

Have you contemplated writing to him with a copy of the latest stuff and a reference to your case to show that he was wrong?
  • I know, ditto!

I think JP has mentioned his daughter was on the same delayed flight and perhaps there's going to be a victory in the family soon.

I don't think she could add you to her claim form could she? I think that's where the court is wrong, in light of the SC ruling it should be possible to re-visit cases where a Judge has ruled incorrectly in law.

I don't think there is a mechanism for revisitng cases where the judge was proven to be wrong on a point of law, It has to be done on appeal within 14 days. Unless anyone knows otherwise.
Oh yes the letter to judge will be sent. It will make no difference and be water off a duck's back but it will make me feel better...:D
There maybe some contention as I did inlcude my daughter in particulars of my claim (but not as a named claimant at the head of the claim) on the MCOL submission. Jet2 counterclaimed that I didn't have sufficient locu standii to claim for her. Since they won their day in court (for once) they must be right ;)

  • Oh I've quite rightly replied that I appreciate they are busy, but just wanted some kind of personal feel to my case.

But have had a team leader on to me replying, so fair play to them.

They are more than welcome to my 27% (+ 25E + Interest if any) but just a little request. I'm hoping I'll be getting word back in some way very soon anyway, the wife is a tad more worried as she gets sick with worry about going to courts, lol.

  • Sounds promising, let's hope can get a settlement without the need for a court hearing.

Glad you now feel more confident, since your recent contact with Bott.

  • Has anyone using Bott and co received a payment from Thomson since the Dawson vs Thomson decision?

See my post in BA Thread

My claim was turned down by BA. I wrote again stating I would take my claim to small claims court and they never replied. I instructed Bott & Co to pursue the case and now that the Jet2 appeal was thrown out, BA have settled my claim. I found Bott & Co very professional, easy to deal with and great at keeping me up to date about my claim between May and December 2014. I have no problems paying them 27% of the compensation.
