Dear jaysudra, Peace on to you.
Thank you for your kind words.
Legally there is a battle to be fought. In my view, if the Service Providers loose the battle in court, they will not just have cancellation letters, but also anyone who canceled and was charged a fee (penalty) for cancellation, in the last 6 years could challenge this fee. A few more people will see justice.
FOR THE ABOVE REASON, THE SERVICE PROVIDER IS LETTING GO RATHER TO RISK A COURT CHALLENGE, HAVING TO OPEN YOUR BOOKS IN COURT.
I had already initiated the process for investigating the cancellation fee. This means they may hear from Office of Fair Trading soon (within the next 3 months).
As you said, what ever they decide, we will see this to the end.
You Credit file will remain unaffected. Please copy and paste the information in the second letter template on this forum: http://forum.mizfar.com/viewforum.php?f=4
Those who had legal understanding, may wish to risk not holding the word for the 30 days. Therefore use the letter I drafted referred to as the second letter.

Normally a contract with airtime provider is made either online (on their respective website) or in store by filling and signing their respective forms. As advised by Trading Standards, have anyone asked a service provider that do they have the official copy of contract? If any one is using services, operator must have a signed copy of contract. If they don't have the copy then where is the contract between user and operator? This might be a state of absence of "formal minimun period contract".
Besides this, I have seen many comments that they can / can't take us toe court as these cases are in 10s of thousands. Normally, operator don't drag you to the court, they only refer it to debt collection agencies and for them dealing with 10s of thousands of cases in not a problem. Usual outcome of such cases is that all future credit deals become close to impossible.
To me, getting cash back through any negotiations between MC & agencies seems out of the window. We either can try to use the state of absence of "formal minimun period contract" between user and service provider to cancel the contract. if this is not realized, then downgrading would be the option.0

            Peace on to all,
I have sought help from 1 individual to issue a complaint to the Information Commissioner because the Data Controller (Airtime Service Provider) refused a Data Protection Act 1998 (c29), Section 10(1) NOTICE. This means that the information commissioner will make a decision. Dependant on what the commissioner orders: users will be able to refer to the same point, and suspend any adverse information from apperaing on their credit file.
 In brief the argument is:
When you have issued a notice of cancellation any recurring monthly billing cycle in not valid. The Airtime Service Provider therefore needs to send you a final bill. With the final bill you have raised some specific issues, (dispute) with the amounts demanded, with the view they are unlawful.
Therefore Airtime Service Provider, cannot say you a one month behind payments. You are not behind with payments.
 I will keep everyone updated.
Hope this makes sense, if not don't worry.
 Gus

            Peace on to all
I have one question to all
we all are discussing about the cancellation of our contracts and are fighting with Service Provider while why not we discuss that what /how we can/should do againest The Directors of both the companies,Because these are the responsible for all the matter and according to last information which I got from this forum that untill now they have not declared Bankrupcy. So it means they are not disappeared and their companies are STILL legally excisting.
 Kind regards0

I'm afraid you don't understand company law. Limited (assuming they were) means you can't pursue them in that way at all.0

            Hi all,
Well, it looks like this sorry debacle will be joined by mobilephonesontheweb cusomters as well. Hello!
I don't know if anyone has seen the updated advice from Trading Standards, but it's not good news. I'll be getting in touch with Vodafone on Monday.

The recievers were meant to be contacting everyone who registered their details with DEXTRA Soltions last week, but I've not heard a peep from them. Has anyone else?
I'm a bit gutted, but as mobilejunkie has rightly pointed out - it was always a risk to take, and I've had a couple of contracts which have worked out - so overall, I'm not too badly off.
 Best of luck everyone,

Well, I had a near miss with Mobilesphonesontheweb. I did eventually take the plunge but (in error) Vodafone declined my application - otherwise I would be in the same boat and have lost my first cashback ever. I was never entirely happy with them but like you and a few others from here would have gone the legal route. I hadn't thought it so likely they would go bust - especially so soon after they appeared in that guise - so you really do have my heartfelt sympathy. As you say, if and when things like this happen we can do little but accept it, limit the damage and (hopefully) remember that the loss was more than offset by all our other successful contracts.
I started looking again at "riskier" sources after many successful totally free deals from the safe (but less attractive) sources. I would have at least limited the risk by the size and number of deals and spread them around, but a lot of people with Mobileconnections seem to have taken out numerous very expensive cashback deals and have now lost thousands. It is a lesson (again) unfortunately!0

It's just one of those things, I am annoyed, but am not so deeply in as some people - I didn't want to take the risk of multiple contracts.
Do you know what the situation would be if Vodafone do agree to terminate my contract? Would I have to return the phone, or is it the property of MBOTW?
I don't want to phone Voda unprepared.
Lucky escape for you! Thank god for Voda inefficiency eh?

I did very well as a result, actually. After a about 1-2 months complaining to them about that and a few other things (the list grew longer the more I struggled to get my complaint heard by anyone) they gave me what amounted to over £50 compensation. Not only that, but Quidco tracked at a higher amount than it was supposed to and actually got paid the same month! Guess I just have the golden touch, but I had made an error of judgement with them in the first place.
I'm really not sure about the phone. I would try to get Vodaphone to agree to terminate the contract but not mention it unless they ask! You can always change your mind if that is important to you when they do! I'd also make absolutely certain the company itself has gone into liquidation first or you might invalidate the cashback claims in the unlikely event they are paid eventually.0
