  • ABTA is an example of a protection FOR the industry and NOT the consumer. In fact, in the VAST majority of cases people would do MUCH better using the courts - I did that twice and got a LOT more back than I ever would through ABTA. ABTA is a con - and an example of what I meant earlier. Having a safety net like ABTA if a member went bust is worth considering, yes. BUT remember everything which increases operational costs reduces the deals that would be offered by the larger comanies who are far less likely to "disappear". Things like these need careful thought rather than heavy-handed reactionism. Too little intelligent thought is usually put into the changes which are imposed as a result of a headline. I merely hope that if/when changes are made they are far better thought out than is usually the case and not too hasty!
  • I worked as an Agent for Mobile Connections,selling all my contracts with the best of my intentions. The Cheque for the commision of July bounced. I have my invoice and cheque. Can I take this throught the Small Claims court. The value of the check is nearly at £1000. Any Body advice me on what options are avaliable to me. Are there any other Agents who are in the same situation?

    You can use the small claim court, and would probably win, but then it is up to you to enforce the judgement.

    It seems highly unlikely the firm has any money to pay out, so you paying out for a summons to be issued seems like sending good money after bad.

    Well Yes and no.

    Agents get paid PER connection we do. Customers get paid on a monthly basis for the cashback they are owed.

    As I have an Invoice and a cheque(that has bounced) and the value is more that £300 single claim,doesnt that make my claim more credible?

    As already posted, you seem to have a high chance of winning a county court claim over the bounced cheque.

    But to make a claim will cost you a court fee.

    Once you have won, how are you going to get paid?

    So what is the point (apart from the personal satisfaction of winning a ccj against them, you will end up financially worse off than you are now)
  • Thanks for your advice quentin, What will happen if the company does declare bankrupcy and all the assets will be sold off(not sure how that works with an PLC), will I not be seen as a 3rd party who is owed money from MC as I have the invoice of them paying out.

    Yes - you are a creditor, and should contact their liquidator (when they are appointed).

    I'm at work, but put Working Lunch on timer to record, so am looking forward to watching it this evening.

    The 3 network stopped paying out commissions to MobileConnections and withdrew their contract, hence MC stopped selling 3 mobile phones. Rumours are they were in financial trouble and started selling 18month contracts, as more commission was to be gained from this.

    I'm not heavily affected, but even so, it's good practice to eliminate rogue retailers.
