    I have started to initiate the process of having the authorities investigate the directors of the following organisations:

    As far I am aware all are trading independently, that is in their own right, but I suspect that the tax man does not share the same view. Never the less, I am not going to be able to bring criminal proceedings simply because they refuse to pay Cash Back, neither can I ask for them to be wound up, as the amount they owe me is to little less that is £300 - £400.


    The issue is being passed on from different government agencies, thats not because they are incompetent, but because it should be dealt with right one the specialist for this type of matter. Director committing crime can not seek to limit they liability under the articles of memorandum or by shares.
    Trading Standards may bring this to the attention of the former DTI, I'll await they decision. The meeting between service providers, ofcom and them will be a key thing, and I suspect they will need legal advice. But I cant propose that they (service providers) redress any one if They have paid commissions to the agents and the agents are still trading.


    The other point is simply because you close your shutters, that doesn't mean you have been made insolvent. the same applies if you refuse to pay your debts. Only a Court can make you bankrupt. There are exceptions. As previously I explained regarding wrong doing and personal assets.


    This may mean those who had not followed the morning points I raised to use to terminate your contract as unenforceable in common law, may if they choose issue legal proceedings against the group, for the amount of cash back due. But not yet, not until the government agencies can clarify who actually controls the accounts of Mobile Communications and who has the authority to operate.


    Therefore at this stage its better to either demand cancellation or by take a reduced affordable tariff from the service provider.


    If they have run away, it would be after they had sold the Company, I also believe the instructions filed to reverse the decision of purchase is unlawfull, but the government agencies need to investigate that. The Law around that is complex not my area.


    I will be around tomorrow at bordesley green with the trading standard letters, to give out and help any who need and require any point of view clarifying.

    So do you think the letter will work - know early days yet but what is the next process. Is trading standards going to meet OFCOM and airtime service providers and do we know if this happening for sure. If so when?
    Have you met with trading standards yet and on a personal note what are they saying as the above is just a general statement

    Im from lanacashire so not sure how i can get involved. Dont really want to downgrade as then we will lose all rights to cashback(if it ever happens which i doubt anyway) as we cannot downgrade.
    we cant really cancel direct debit either as the service provider is still providing a service to us.

    Any opinions and advice appreciated from GUS and anyone
  • Sorry; I think you're clinging on to false hopes. Any government agencies are toothless and incompetent and are highly unlikely to get your cashbacks. The networks WILL have a separate binding contract with you and if the company isn't around anymore you can't sue the only people who WOULD have to pay you. Keep knocking but don't really expect any worthwhile doors to open.

    my friends had contracts with orange throught mobile revoloution, a cash back shop in astop. they also did a runna but luckily for my friends, orange (alos vodaphone o2 and some other networks) made a change to thier terms and conditions saying they will charge for certain calls. there is a term that says is the network provider makes any changes to terms and conditions that affect you, you can leave. there is alot mor einformation on this link
