  • :TBank:Intelligent finance
    Amount claimed: £1625.00
    Amount paid: £1625.00

I wrote my first letter asking for a list of charges on 19th April, recieved list of charges two weeks later, then wrote second letter using templates from this site, recieved a letter back offering me half the money as good will gesture, i promptly refused this offer over the telephone, and i was told by the women on the phone if i refused the offer and asked for the full amount i might not get anything at all! I then sent a final letter threatening court action if they did not give me the full amount and today SUCCESS !! at last, i revieved a letter offering me the full amount that i asked for. The whole process has taken two months but has been well worth it, Thankyou so much to Martin and his site for all the help !:j
  • I just thought I would drop all you guys a quick note to let you know how we got on, claiming our bank charges back from the Abbey. "WE'VE DONE IT!!!!" It's been a slow process, but that was mainly down to the length of time we took to use moneyclaim online. Our initial claim was for £3537.

After sending the first letter to the Abbey, we recieved the standard letter back saying that they stood by their decision and that their charges were fair. We went back to them saying that we disagreed & that we intended to pursue it further. Surprisingly we recieved a credit into our account of £720, without warning or explanation.

Eventually a letter did arrive expecting us to take the credit as final settlement. We again went back disagreeing, saying we would pursue the full amount via the court. We initiated the legal process via moneyclaim online. Lo & behold the week before their deadline to put in a defence, we recieved another letter from the Abbey saying they would pay us £2377 (less any other payments already made - in our case £720!!) as a good will gesture, but denied they had done anything wrong. However when the cheque was finally recieved into our account on Monday it was for £2377!!!!!!! This also included the £120 court fees!!

We fully expect to recieve a letter from the Abbey telling us to Get Lost & bank elsewhere. So, before they do, we will close our account!!

I would urge anybody else thinking about having a go - JUST DO IT!! You have nothing to lose

Martin you are an absolute Genuis. Your straight forward explanation of this process has been an absolute God send and we are now £3K better off for it. You should get a Knighthood for you services to the British Public!!

    Started my claim early March.
Sent all the necessary letters, filed on MCOL, got court date for 12 July, was just starting to put together court bundle ... received offer letter for the full amount today!

Thank you Martyn Lewis, you are a hero, but I expect you have heard that a few times by now.:j

I claimed £1056 and filed my claim on the 18th May 2007 which was served on May 23rd, the Nationwide acknowledged on the same day through a solicitor, who filed a defence with MCOL on the 18th June. I fully expected to have to go to court and was prepared for it but today, 21st June, I received a letter dated 20th June confirming that they would repay £1001.24. The money is already in my account, and I'm happy with that, so I've settled.

Thanks Martin and everyone who has contributed to this site, which motivated me to make the claim and provided guidance on how to do it correctly.

  • Bank - HSBC
    Claimed - 916.00
    Received - 722.00

I've accepted this amount, even though the bank refused to repay the
interest, and claimed some of the charges were outside the 6 year limit.

They weren't outside of the limit when I started the claim some 3 months
    ago!

The banks must realise that they are in the wrong. If they had any legal chance of winning they would have simply ignored all the claims that have been made against them.

    Thanks for your advice.
  • Bank Woolwich
    Amount £700.00 got back £550.00.

This is my first post on the forum - I have been using Martins site and information to help me reclaim my bank charges (I also got money back from them because they over charged me when I changed my mortatage over - again thanks to info on Martins site).

It took me months to get my butt into gear and write to the bank and Im glad I did ............... so if anyone else is wondering if to writeto the bank - then my advise is do it and your will be pleasently surprised (Im sure)

    THANKS :-)
  • Just a quick update from me.

I got a judegement bydefault against the Halifax for the full amount of the claim plus costs

No money or contact was forthcoming from the Halifax. I faxed them telling them they had 7 days to pay (by close of business 21/06) or I would get a warrant.

No contact or money was forthcoming.

I telephoned them on Tuesday. They told me they had no knowledge of my court action or win and told me a manager would phone me to "renegotiate". I politely pointed out that a court win means I don't have to renegotiate.

I was told a manager would call me back before the end of the day. No contact was forthcoming.

8am yesterday a manager rang me stating they had no knowledge of my claim. I politely pointed out that as they had acknowledged my claim and said they would file a defence that they must have been aware. The manager then told me I was trying to claim too much money (but gave no reasons). I politely pointed out that as they had had their chance to file a defence and didn't that it was tough. The manager said he would investigate. I offered to fax through copies of their acknowledgement & my judgement. My offer was declined.

10am yesterday same manager phoned and told me they would pay in full before 8pm.

Money was in acc by 2pm yesterday.

Thanks Martin & others on the forum for your stories and tips on what the banks tactics are.

My advice to anyone is STICK TO YOUR GUNS AND DON'T BE OUT OFF BY ANYTHING THEY SAY TO YOU!!!
  • I'd just like to say a MASSIVE thank you to Martin and everyone from this site who helped me claim my bank charges. Thanks to the advice from here I successfully got Natwest to offer me £2,235 in unfair charges from the last 6 years. It took long enough to get it sorted, I was just commencing legal action when I got the offer through the post! So, after 3 letters I finally got the result I wanted.

Thanks again to all who gave me advice. This site is a goldmine!!!!

    Lloyds TSB

    Amount Claimed - £1738.74 (£1518.74 Charges + interest; £120 Court Fee; £100 Allocation Questionnaire)

Amount Offered - £1752.39 (The above + interest accrued on charges since the beginning of the journey)

I have followed the advice of MSE to the letter, and went as far as posting the Allocation Questionnaire - about 9.15 this morning. At 10am, two letters from Sechiari Clark and Mitchell - the first I opened said that they were to defend the case. The second one, without prejudice, basically set out how they felt that their charging was legal, and that my claim for repayment was misconceived. I turned to the next page, and it said that they are willing to settle in full, including an extra £13.65!!!!

Result, and for any one else on the journey, hang on in there!
