    Wow I never thought I'd get to post on this thread :j

    2 accounts total charges £1017.
    First letter sent out 20th January so this has taken 5 months!
    Was ready to attend court next Friday the 29th, court bundles all completed and posted out and I thought they were going to make me have my day in court.
    I have written and faxed SCAM many times never even had the courtesy of a reply but today monies are in the accounts.:D
    Thanks so much to everybody involved with this site for the support and advice.
  • Sent claim letter 27/04/07 - received 30/04/07

    Rejection letter 03/05/07

    Sent court threat letter giving 14 days 11/05/07 - received 14/05/07

    Phoned 01/06/07; 04/06/07 and told will have to wait 8 weeks from original letter ie 21/06/07

    Rang 01977 number 18/06/07 and told to expect something in next couple of days.

    20/06/07 Just checked my halifax account (not using it anymore) and there was £181.00 deposited in it!

    21/06/07 Called to request remaining £181.00 waiving interst charges and Halifax accepted.

    Thanks to all who guided me through this :T :T and was definatley worth the effort.

    Have recommended this site and the need to do this to all of my friends.

    Lloyds TSB paid out £256 in April (haven't been on for a while) after I complained to the Ombudsman. More than I had claimed for as they had charged me since!

    Took natwest through to the court stage, they eventually sent a gesture of goodwill letter stating they would pay 1973.00 , recieved cheque this morning

    Sucess! I followed the steps on MSE and looked through the forums. I orginally requested a £28.00 refund at the beginning of the year, which my bank paid and got me to sign to say this would be a final payment and all furture charges would remain... Then they charged me again a few months later, so i thought, what the heck! I wrote to them asking for this £28 to be refunded, they wrote back enclosing information on all the charges they are able to refund. Seemed a bit strange as i was expecting a letter informing me that i had signed an argreement with them not to claim any further charges, i'm not sure what the legality of the document i sign was, so i went ahead and requested my last 6 years statements, went through them, photocopied them all and wrote down exactly everything i was claiming for.... then 2 weeks later a reply, they were looking into it and would get back to me. Then nothing. I wrote again to see if there was any progress. No reply. Then another 2 weeks later a letter offering me £10.58.24, which was just short of the amount i was claiming for. Not wanting to appear greedy and happy enough with the offer, i accepted... Paid straight into my bank another 2 weeks later! Hooray!! I've used it to pay of my overdraft with NW and now my bank account is in credit for the first time in about 5 years! God knows how much interest i've give them over the years!

    Anyway, good luck to all who are going through this process, i hope it all works out. I didn't even need to send the "i'm taking you to court, unless..." letter. NW seemed pretty easy to get the money out of, but looking through the forum, they seem to be one of the better ones at paying out. My partner couldn't even get £60 back from A&L and is having to make a small claims court claim! Thanks to you all for the info on here, i couldn't have done it without you!!

    Claimed £3062.52 (including interest and £120 court fee)
    Received £3062.52

    Went through the usual process, Halifax never replied, so I applied to the court. The date halifax had to respond was Monday 18th June.

    I did call Halifax on 13th June and said I would settle without interest (£230) and court fee (£120), but was told that they were defending and to basically go away.

    Nothing heard by Monday 18th so I filed paperwork and called court next day (19th) to be told that there was a backlog of defences and that priority would be given to the defence as the problem was at the court. I settled back awaiting their defence resigning myself to having to see this through to the bitter end (but undaunted all the same, and determined to win through)

    Just had a call from my wife to say a letter is here and Halifax have settled the full amount

    What a feeling

    What a flipping feeling!

    To think, if the snotty young boy who I spoke to last week had settled he would have saved them £350 :rotfl:

    Started the process back in March and sent letters to Natwest asking for my charges back which were all ignored. Filed online with MCOL and after the 14 days still had no response so entered judgement against Natwest and won. I did receive a letter from Natwest offering the full amount of charges but not interest or court cost so I thought I'd push ahead for that as I won judgement. Or so I thought, received a letter yesterday from Cobbetts defending the claim. I rang them to say I had already entered judgement but they had got their defence in and MCOL had let me enter judgement incorrectly! :mad: A very kind lady at Cobbets Solicitors asked me for my list of charges which I sent to her via email and I also included the charges I have incurred since the claim was filed. She amended it a bit but did include interest and agreed to pay the charges I have had since the claim! A cheque is in the post Special Delivery tonight!! So as for you only get the interest if the courts award it thats not neccessarily the case as you'll see from my experience.

    Anyway thanks to Martin :money: I owe you a drink!! :beer:

    The story: Sent first letter in march - no reply, 2nd letter - no reply. Started worrying about taking the mighty Natwest to court so did nothing. Got letter in post today offering the full amount ( about 5 weeks after 2nd letter ) - totally shocked. Cant thank Martin enough.

    I started by Printing off 7 years worth of statements (which convieniently you can do on HSBC's Internet Banking site - I never realised you could go back that far online until I accidentally stumbed across it one day), and highlight all charges. I sent the appropriate pages with accompanying letter through to HSBC on 27/3/07.

    I received a reply on 09/04/07 requesting me to re-send them the information in their desired format (a stalling technique I assume), which I did the same day.

    After 3 weeks I had received no reply, so I wrote a final letter stating that this was their last chance before court action, and gave them a further 2 weeks to reply.

    After another 4 weeks I had received no reply, but by then the Lloyds case had happened and I was more than a little skeptical that I would receive any money back.

    So I decided to call the bank, and try and use the 'I am a valueable customer and I will just take my business elsewhere' tact - As although I had charges in the past - my credit rating has improved significantly over the past couple of years.

    But I didn't even have to use that, I spoke to a very nice man who informed me that a letter had been sent out to me 2 days previously offering me £476.50 (which was my actual bank changes incurred). Lo and behold I received the letter the next day.

    I signed it and sent it back last week, and the money arrived in my account yesterday.

    I thought it was wise to take what was offered and not conitnue to try and get the interest back, as I had originally claimed.

    As an additional note, whilst my claim was going ahead, I had cause to have to visit HSBC about a transaction query, and to my surprise the man that helped me that day, did not make me feel uncomfortable about claiming and was very helpful, and even offered me furter products and an increase in my overdraft if I needed it. There was no hint at all that I would have any problems with my facilities being withdrawn.

    Overall very pleased. Thanks Martin for the great advice.

    I have now used this money back to pay off the last of my credit cards. I will never rack them up again!!!!:j :D :j

    Amount Received: £30

    Halifax forgot to send me statement in October 2004 so I paid late. Charge refunded immediately. They assured no impact to credit file. I just found the late payment when I check file recently. Complained, asked for fix and £30. First 2 letters received stated there was no late payment showing on my file. Sent copy of file and got it fixed plus the £30 just for my time and effort. I'm quite quick at writing complaint letters now so it was worth it, and my credit file is now immaculate.
