  • after years of being treated like something that the HALIFAX stood in just wanted to let you know.I sent my £10 and subject access request in dec 2006. after two complaints to the ICO, I finally recieved the information in may this year. I started court proceedings Halifax acknowledged the claim and said they would defend, time would have been up on 20thJune. Today I recieved a letter saying that the Halifax would send me a cheque for the full amount plus interest plus court costs. This was after being told the I did not know what I was talking about and that I would never get another bank account as bank's did not like people like me (poor) how wrong they were.

    I just won my little battle with Halifax myself. It was worth £150 and has taken 2 months of patience, but after filing the court claim and having the bank agree that they will take it to court, I just got the letter that they'll pay up.

  • couldn't believe it! I'm well pleased! received a cheque from solicitors on behalf of clydesdale bank.
    amount rec'd £466
    claimed £800.
    Sent first letter requesting refund 7.3.07 and followed this with LBA 20.03.07.
    Reply 26.03.07 saying they were looking in to complaint. then nothing till I received the cheque on 15.06.07. that'll do me!!Yipee!!!!

    After following all the suggested letters and procedures, filed a moneyclaim claim, they acknowledged my claim after 13 days, i was then waiting for the solicitors letters and a court date some time in the distant future.

    But.....

    Letter arrived on monday, saying they were liable for nothing blah blah blah, but as a 'goodwill' gesture they offered me 4,190 (my claim was for 4,500).

    Needless to say the offer was accepted and the reply sent straight back.

    Recieved: £1421.04p !!



    Well I am absolutely buzzin :D ... I didnt think I'd ever get to write on here because HSBC have dragged this out as long as they could. I started this back at the beginning of Feb! ....Had all my staements online, so sent first letter on 6 Feb .... got standard reply of "we're looking into it and will be in touch in 8 weeks". I decided to stick with the plan and sent the second letter 14 days later, threatening court action. This time they ignored me completely. Around about this time I was unfortunate enough to be inbetween jobs and on Income Support, so I filed my claim through Birmingham County Court (yes that one) so that I would be exempt from the fees. They aknowledged straight away intending to defend all the claim :eek:
    Right at the last minute they put in a defence and I thought "Oh god, i'm going to be the one that they make an example of and I'll lose in court".
    Anyway, on 14 June I got court date set for 27 June. 2 days later (16 June) guess what came through the post ...... yes a letter from HSBC's solicitors saying "that they believe the charges are lawful" blah blah blah ..... and that even though they'd win in court etc .... they are prepared to make an ex gratia payment of £1421.04 :D
    Funny thing is .... they added on court costs that I didnt have to pay in the first place :rotfl:
    As I'm a single parent, this money will help a lot ..... and me and the kids have now got huge smiles on our faces because it means the kids can go on holiday this year :D

    Amount Paid: £2342.39

    I started my claim back on 13/12/06.
    Sent two letters with no success, I received £750 as a goodwill gesture on January 25th in the second letter threatened court action, took claim through MCO bank defended the claim, this was then passed to my local county court (Southend), which then was read by a district judge in April, who set a date for the claim to be heard on 27/06/07.

    I heard nothing, I began to prepare my case, then on Friday out of the blue I received a letter from Lloyds TSB's solicitor offering me a full settlement including interest, but the solicitor says they are not admitting libility!!

    The £1592.39 (total less the goodwill £750 paid in January) was paid into my Lloyds account on Friday and transfered out by me the same day!!:beer:

    Hi All, my name is Mick. I have paid to A&L £660 in charges over the last 6 years.
    By following the letters on this site, I have been made an offer of £220 refund.
    I have accepted this offer so thanks to all concerned.
    Also I have contacted Natwest with which I have paid £2400 in charges.
    Hopefully a similar result will follow.
  • I had to take the Halifax, for myself and my wife all the way to court.

    But success! got the letters saturday from the bank stating the cheques will be in the post in the next 5 days £712 in total.
    LLOYDS TSB NEXT!!!

    RBS has paid £1,833 back to us, even though they say the charges were for services and not charges for going overdrawn.
    They also said they were not admitting liability and it was a one " off payment "
    This took about 8 weeks as they said I had sent the letters to the wrong address.
    So glad its over and thanks to MSE and all who contribute to this fight.
    Good luck to all who are still battling.

    After sending each letter we received letters from the bank stating that they were looking into our complaint and would get back to us. We began court proceedings after the time period we had given to the bank to respond. Although the banks address was in Scotland (bank of scotland) we put the halifax address in leeds on the court document so we could claim the full amount. This worked and we received a letter from the bank offering us a full settlement with interest plus the 120 pound court fee we had paid. This came one week after receiving a letter stating that they would fight us in court. All in all, after lots of posturing the bank paid in full.
