I have just recieved my money from Natwest after going all the way through to getting a court date and them changing it to my local court !
Natwest sollicitors sent me many letters asking me for additional information which was really hard to understand !
BUT THE MAIN THING THEY KEPT BRINGING UP THAT MY CHARGES WERE DUE TO A BREACH OF CONTRACT !
SO I WENT INTO MY LOCAL BRANCH AND ASKED FOR A COPY OF MY CONTRACT!
WHICH THERE REPLY WAS THAT THERE WAS NO CONTRACT AND NO COPYS WERE KEPT AFTER 5 YEARS ANYWAY !
THIS WAS GREAT BECAUSE THIS MEANT THAT THERE IS NO PROOF THAT I AGREED TO ANY TERMS AND CONTIDIONS (MEANING THAT I DID NOT AGREE FOR THE BANK TO TAKE MONEY OUT OF MY ACCOUNT !!
there for this should be everyones main port of arguement and should ask there banks for a copy of the contract ! (which i should imagine they won't be able to supply you with) also a copy of the terms and conditions you agreed to when you opened the bank account (not the up to dates ones)
at 1 stage i thought i would not win and that i would have to go to court luckly i stuck with it and I won.
KEEP GOING EVERYONE YOU WILL WIN IN THE END !!!

Just thought i would post to say we have been awarded our credit card charges back from alliance and leicester after we had filed at court total amount was £510..
just waiting on the F.O to decide about whether alliance and leicester were fair in closing down our bank account because we claimed £1000 at mcol stage..:mad:
for those who have appealed about this procedure to the F.O i will post when we get an answer back

The story:
Sent £10 and asked for 6 years statements and received no problems.
Worked out amount owed and used Martins interest calculator to calculate interest- Sent the template letter asking for the full amount plus interest.
Received standard letter saying basically no way, you knew T&C's, you breached them and the charges are fair etc.
sent second letter to nationwide offering to ignore interest if they settle now at £3009
Received the same standard letter back again.
Paid £120 and filed with Moneyclaim online.
Nationwide acknowledged claim and stated they intended to defend.:eek:
6 days before the 28 days were up we received a letter confirming the full amount claimed plus interest has been credited to our account and pending charges were cancelled.:j The letter finishes with a little warning that the account will be closed if we do not comply with their T&C's in future
We started the claim in february before the recent TSB story, of which when we heard we thought typical just our luck its all gonna change now but we went ahead with the court claim after the story broke and its gone in our favour, so dont be detered guys, keep claiming cos they are still paying
Thanks Martin for all the free info getting the money has literally got us back on our feet, we are debt free with no cards, loans or overdrafts and we intend to stay that way!!0 -

My claim was for £825 plus interest and having been offered £625 I am happy, thank you very much for your reliable process.
I have been sent an acknowledgement letter for signature which states 'full and final settlement'; while I fully intend to avoid charges in the future I don't want to limit my rights and as such intend to include a statement to this effect. Any further advice would be thankfully received.

After reading the reports/advise on this website I instigated my Son and Daughter to reclaim their Unlawful Bank Charges - My Daughter rang today to say that her Bank (RBS) have paid her back in full :j and after just the second letter stage!! - Great Result and thanks for the encouragement!!! Just awaiting my Sons outcome he is with TSB :beer:0 -
First Direct were very helpful - refunded £90 back, no questions asked and very quick
Barclays were a bit funny but refund the full £180 - eventually
We recently tried to increase our Barclays overdraft up to £1000 from £500 but they wouldn't let us - and they couldn't explain why - see their ar$3 I think !
Now cancelling Barclays and fully moving over to First Direct :T0 -
Hi I would just like to let you know that I have received back a letter from GE Capital Re Dorothy Perkins, Burtons and Evans charge cards. They have agreed to repay all the charges in full to me within the next fourteen days but wont pay the interest, I am not too worried about this as i will be getting back just over £700 pounds from the three store cards.

Well i've just got in from work and i had a phone call from MBNA (i'd filed with MCOL on the 30th May and i've heard nothing since and they had until Wednesday to put in a defense) asking if i'd recieved their offer?? no, what offer?? we sent you a letter offering you £110 (full claim for £250) I've never recieved this:undecided, they checked their records and my address has been put in wong so it went to 10 doors up the road (who haven't sent it to me by the way!!) so i said thank you and sorry i never realised you were willing to negotiate and hence why i filed with MCOL. We had a bit of a natter and explained that i never wanted it to go this far, he was fine and said they have hundreds of them...
He (colin) was lovely, i have to say that was one of the nicest conversations i've had with a bank, he was friendly, approachable and willing to talk and listen (colin if your reading this, thank you)
I said that £110 wasn't good enough for me to settle and he said he would refund me in full...the whole £250!! YEEAAAHHHH!! :T

The cheques will take 24 hours to be dispatched and then with me and then once i have them in my hand i will cancel my claim with MCOL.
What a lovley end to my day and completely unexpected!!xxx

sent initial letters at the beginning of march, received reply last week saying no return of charges would be made. phoned up the bank and told them i was sitting on the MCOL website with all details filled in and ready to proceed. person on phone then said an offer would be in the post within two days. received offer of £690, phoned up again and said i wasn't happy with "insulting" offer and i would be going to court. immediately offered an increase to £1035 over the phone which i acccepted as i thought it was money gone forever!
a little polite aggression works wonders, and fair play to the customer relations manager i dealt with who was very helpful!

They hadn't replied to any letters. I put a claim in through MCOL. At the last minute they defended, arguing that they were "embarassed by the lack of particularity in my claim" and would argue for it to be struck off if I didn't correct this. I spent the weekend making sure I'd got the amended wording right and sent it off to the court with a cheque for £35 on Monday morning. Came home to find a letter from NatWest paying £2845.00!! I accepted. Thanks to all who've given advice. I am now almost out of debt!! :beer:0
