Hi everyone,
I shadowed this site for a while looking at all the posts and downloading the bank charge forms. I had bank charges for £480 (inc interest) with the Halifax and decided to reclaim after reading the threads. I followed it to the letter and after the 2nd letter was not answered in the time frame I rand the Halifax team who told me over the phone that they had sent an offer letter offering me £250.
I declined this and they advised I would have to speak to the person who wrote the letter. They transferred me to this lady I said I wasn't happy with there offer and she simply replied what would you accept. I said £450 (£40 less but I had left in some they had refunded). And she said "OK then I will send out offer letter and you will have money in 2 weeks" :j 3 Days later I got the letter and days later the money was in my back with no threats whatsoever to close my account.
So don't give up there is light at the end of the tunnel0 -

No offer at any stage, went to the FOS as couldn't face the court. FOS sent me the offers within 10 days.
As a family we have 6 more claims with the FOS ,having followed the timetable and used all the template letters.
Thank you Martin - it is people like you who should be honoured.

I posted in a thread yesterday about reclaiming my bank charges from HSBC of £50 due to going overdrawn twice. once for 5 days and the other for one day. I went to the bank and explained that i wanted to see someone. the gentlemen said i'd have to put it in writing and i said no i want to deal with someone face to face. so he took all my details down and booked me in 45 minutes later. I came back and a member of staff asked me aside and asked how could he help so i explained that i acknowledged going overdrawn but dont acknowledge the charges of £25 for going overdrawn as I hadn't recieved any correspondance from them. the member of staff said no problem and would refund my charges    :j :j :j0

Bank: American express (blue card)
Amount Reclaimed:£75
Amount they paid:£46
The story:
followed the process to the letter. Amex returned my £10 cheque initially and sent records. Applied to recover 3 x £20 in late fees + interest (approx £75).
got first letter - with all the old flannel, sent 2nd complaint letter and they sent back a cheque for £46. (they have dropped the original charges to 3 x £8 which is the current late fee, refunded the difference with interest at 8%). I am relatively happy with the result although i am unsure if i should push for the full amount.
If i get anyone telling me that they continued to pursue and got the full amount within the next few days (from amex) then maybe i will. But i have to say i am pleased with the result.
Thanks MSE for all the advice

Threatened Court action - 24th July
Letter received - 3rd August suggesting a further 4 weeks before contacting me.
Replied - 6th August informing them I was very unhappy with their stance.
Letter received - 23rd August RESULT.
The letter contents:
" I am sorry that you have had to write to us and for the delay in my reply.
I can appreciate that youy are unhappy with the charges that have been applied to your account. As you are aware, the charges are valid and in line with the terms and conditions of your account. After reviewing your account, I can confirm I have refunded £335 as a gesture of goodwill on this occasion only. This credit will show on your next statement. Please be advised that the £11 charges are not subject to refund as the Bank reduced the charge in line with the Office of Fair Trading statement."
I am not going to dispute my result, however the OFT statement is one that
the Banks will 'hide' behind, some don't even agree with the OFT ruling but when it suits them they use it.0 -
Bank Lloyds ( and from a business account)
Amount Won £2000.00
Time 7 weeks
A success story, I helped a friend claim around £2000,00 from LLoyds following the process given elsewhere on this site. The bank settled out of court before commencement of proceedings at the Small Claims Court.
The account in question was a business account which was on the limit of its overdraft and despite a letter from Lloyds claiming that the relevant acts did not apply a quid pro quo settlement was reached where the outstanding overdraft was repaid in full less the £2000 odd in fees. In addition to the heexcess charges which amounted to about £1700.00 a further £300.00 was sucessfuly claimed in lieu of direct debits that were stopped but continued to be paid out by the bank.
And of course, as soon as the claim procedure was started the bank closed down the account and began proceedings for recovery of their debt, which actually worked in favour of the claimee as the debt recovery devision were ameniable to a settlement.
Next stop the mortgage company!
