    HSBC, Iclaimed £1900 and received £1600

    Just got the cheque this morning already paid off £1200 in debts and we're going out for lunch.

    However, I've been put on hold By RBS, My Dad thinks that I can still get a response as I was in "financial distress" at the time that they charged me, and that they knew this as all my benefits were being paid into that account. He believes there is an act of parliment that I can quote to give them a kick into giving me my money back, does anyone have a clue what he's talking about?:confused:

  • LloydsTSB - sent in original claim letters in March

    Claimed £1480, they dragged their heels, got a court date, finally got a letter saying they'll settle out of goodwill including all costs....this was just over a week ago...money appeared in my account 4 days later.

    They are slooow.....but you'll get there in the end...

    I want to start, like so many others for thanking not only Martin, but all the other contributers on here that have steered me and countless others through the bank charging minefield.

    Without your tireless help, support and effort there is no way I would have been able to do this. Now, thanks to the ontirbutions to this site I am over a thousand pounds better off, which I will use to pay off other debts...See - I have learned from my past mistakes!

    Anyway, my story is a brief one - claimed from Capital One through MCOL, using the templates and timescales suggested by Martin and the gang. I received my letter from Cap One on the 14th August offering a full refund.

    To all those thinking about making a claim form a CC Company, do it!

    Again, a huge thanks to all that make this site so useful and inspirational!

    The Story:

    Originally wrote to Halifax back at the beginning of May received the usual fob off and a letter offering a payment of £150 which i declined. Wrote again as set out in template steps and got no where decided to take my complaint through the Financial Ombudsman in July as i couldnt afford to go via the MCOL route. I received a letter back this week informing me that they are paying the full amount back although they do not accept the charges are unlawful or unfair - the usual rubbish!

    Would just like to say a massive thank you to the FO who work for people complaining about the banks and credit card companies free of charge and a massive thank you to Martin and other users of the MSE site who offer great help and advice :T

    The story: I started the claim back on 18th April this year. I got the usual bank reply that I had misunderstood what the facility charges were for. I sent a letter threatening court action they ignored it. I went on to the Moneyclaim website and started court proceedings.

    They ignored everything until judgement was granted against them on 25th July. They didn't pay up so I sent the bailiffs in via the moneyclaim website.

    On 14th August the full amount of the claim was credited to my account including court costs.

    If you have a claim in progress don't give up. My judgement was issued before the OFT ruling so the Bank couldn't argue.

    The Story:

    I got charged for a single bounced direct debit 2 months ago. I had heard about this site on tv, so I found the model letter, changed some details and sent it by recorded delivery 1 week ago.

    I got my bank statement this morning and found that the full amount had been refunded! No explanation, just the money!

    Even though it is a small amount I just wanted to say a HUGE thank you to Martin for making this possible. Long may it continue! :T

    Story:
    Started claim back in Nov 06 after reading Martins tips on claiming back charges.
    Sent first letter off in Dec 06 as given on this site. Got the normal rebuffs from LLoyds. Second letter sent in Jan 07 and again ignored so started claim for money via MCOL in Apr 07. Lloyds put in defence on 28th day.
    Claim redirected to local court (Oxford) and court date set for 10th Aug 07.
    Sent my "bundle" to court by date directed on court order but received no "evidence" from solicitors/lloyds (who were directed to submit bundle a week before me).
    Sent non-compliance letter to solicitor (and court) but no reply from Solicitors.
    OFT test case announced so rang court who informed me my case still going ahead.
    Turned up at court where LLoyds Solicitor applied for Stay, after going through my "bundle" the Judge spoke to both Solicitor and myself, where I had to give my reasons for opposing the Stay.
    The Judge was not very happy with non-compliance from LLoyds.
    The upshot was that the Stay was refused and Defence struck out and Judge ruled in my favour.
    Received cheque in post today, which has now been promptly deposited into my new (not Lloyds - funny that!) bank account.

    So big thanks to Martin, as without this website I wouldn;t have even started my claim. Also big thanks to the CAG as got loads of help on there once it got to court process.

    P.S. Would put a big smiley on here but don;t know how - doh!!

    Another success story thanks to Martin and this wonderful site.

    This was really easy. Sent letter asking for money back approx 10 weeks ago, got two letters during this time stating member of staff will be in touch, heard nothing.

    Got letter today saying don't agree with complaint but as gesture of goodwill (usual !) they will refund the amount to my credit card.

    I am really surprised to be posting here....

    I requested statements in early March and received them on 12th June.
    Sent request for refund letter the same day.
    They sent back standard "get lost" letter on 15th June.
    I issued claim via MCOL on 18th June.
    They acknowledged service on 22nd June with intent to defend - defence received on 18th July.
    I was then sent a court date for early september by my local court.
    Three weeks ago I received another letter from the court telling me that the judge in his wisdom had issued a stay on this case until March 2008.
    I was livid because this was a credit card claim and not a current account. I went along to my local court for some advice and was told that it would cost £65 to apply for the stay removal. I was advices to send a letter to the court explaining the reasons for the removal of the stay without actually formally requesting it (ie filling in the form N244 and paying the money).
    I did this last week and included copies of relevant documents.

    To be honest, I wasn't holding my breath! I fully expected to have to wait for a very long time. The, yesterday, out of the blue, I received a letter from DG Solicitors telling me that they are settling for the full amount.

    YYYYYYYEEEEEEESSSSSS!!!!!!!

    Quite why they are settling whilst the stay is in place I have no idea - but am I arguing????????
