    Another success story :T

    RBS - Received letter today offering £3357.22 in full and final settlement. We're happy to accept the offer and look forward to getting the money paid into our account in the very near future. :j

    My Lloyds TSB account - I claimed £140.00 - they wrote back saying no, threatened them with court - received letter offering me £175.00 which they paid into my account within 2 days!! :T

    Absolutely delighted with the results so far, but still on a mission with the CC companies.

    The story: Well first thank you to this site, CAG site, the BBC report and all the posters and article writers - THANK YOU ALL!!! I started my claim in January - wrote to bank asking for copy statements - very speedily delivered. Went through them expecting to find around £2000 worth and was surprised (and disappointed in my account running) to find over £4000 worth of charges. I entered these into the interest calculator and then wote to the bank asking for them to be repaid using the template letters from here. They sent the standard letter back and offered me £1000 for my time and trouble - Ha! Ha! - I persevered and said I wanted the full amount so would be persuing it in court. Did the MCOL and they entered a defence. MCOL transfered to my local court so I had to pay a second court fee and then I was advised my particulars of claim were unacceptable so I had to redo these 'in plain English'. I was now getting very worried and this feeling wasn't helped when I got notification from the court saying a hearing to decide the track had been called as the judge felt it was unsuitable for the small claim track. I investigated further and last week rang the litigation department and advised them I had a hearing date - The guy I spoke to sounded like a scared rabbit caught in the headlights!! ( I really enjoyed his response) " You have a hearing date Oh Oh We'll get you a new offer letter out, I'll get your paperwork up and if the figures are correct we'll offer the full amount". Well that was last Friday (1/6/07) On the Monday morning I received a call advising that the figures were correct and they would offer me the full amount including costs (I fell off my seat!). That afternoon I received an emailed offer which I printed off and returned - Today (6/6/07) the money was in my account. Now I want the last 6 months worth of charges - chasing the next £600 next week. Thank you Thank you Thank you!!!!

    The story:
    (Note: It's the OH's claim but I use "we" because I pretty much did the work for him so it sort of became my claim too)

    It took altogether three months from start to finish. We had the bank statements already so it was just a matter of writing the two letters then going to court, which we duly did as Lloyds only supplied us with "we are looking into your complaint" letters. They acknowledged halfway into the 14 days, and their solicitors sent us a letter asking for a breakdown of charges (because we had only done that twice before). So off we sent them a third time, and they pressed the Defence button on the very last day. However, anger turned to joy on the very next day, when the solicitors sent their (pretty laughable three pages of) defence and attached two copies of a "Private and Confidential" letter in which they stated that, and I quote "Although your claim has no legal foundation, regrettably the Bank has to take into account the costs of litigating over relatively small sums. The Bank is therefore willing to settle your claim on the following basis" - The basis being that payment of the claim amount will be sent by cheque in full and final settlement, oh, and we have to keep schtum about it. Oops, sorry.

    We sent a signed copy off the next day and went on holiday. On our return a week later there were three things in the post: A Notice of Transfer of Proceedings from the Court (and a note that the AQ be dispensed with), a letter from the solicitors thanking us for accepting the offer and asking us to write to the court to discontinue the claim - and a cheque for £418.07 from the Bank. Which we duly banked the next day - but not before copying it to A4 format just in case we felt like framing it, LOL.

    Hi, not sure I am putting this in the right place but I just felt it necessary to say thank you for all the posts and information which has lead me to successfully claim back over £4,000 from Lloyds TSB and HSBC.

    Both these banks lead my husband and me to lose our home due to their failure to help or listen to reason. I feel now that justice has been done but it does not compensate for what they did to us 5 years ago but it does go a little way to helping us start again!

    Finally I ended up applying to Court with HSBC who responded by saying that they were going to defend the whole of the claim, sit tight as today I received a letter offering settlement, not for the whole amount but a satisfactory amount and I feel justice has been done.

    Thank you for all the helpful information, support and guidance, this website is fabulous, may it continue to prosper and help the little people fight the bullies!!

    sent 1st letter on the 3rd april they received it on the 10th april, i made phone calls every weeks sometimes 5 a week and then on the 30th may i phoned they said an offer letter had been sent out today i received the offer letter it has been signed and sent back special delivery money should be in my account now next week.

    Thanks to everyone on this site who answered my question and thanks to Martin for starting this off.

    usual flurry of letters with first a pro-forma complete refusal, then after I added interest and intimated court/FO involvement, they offered 60%; I refused. Called them today and had a wee chat, and as long I as pull the FO involvement, they'll settle in full. That's all I ever wanted.

    I would just like to thank Martin and his staff, Edinburgh Lass and all the other posters on this site for all their encouragement!:T

    The story:1st letter 4th April 2007,letter threatening to take them to court on 2nd May,replied on the 5th June offering £2850 sent acceptance letter that night said charges were fair & legal blah blah blah.So happy that I stuck to what Martin told me.

    MBNA amount reclaimed ; £606.16 ...... amount they paid ; £686.16 ....... 23rd Feb - sent for statements ....... 29th March - received statements ........ 5th March - 1st letter ........ 10th May -second letter threatening court action. ......... 16th May - leter from MBNA offering GWG of £250 ........ 18th May - declined offer of £250 .......... 21st May - started court action with MCOL ......... 5th June - MBNA filed a defence ........ 7th June ( today ) received cheque in the post for £426.16 as full and final sttlement, phoned them saying that i returned other cheque for £250 nice lady said no problem another cheque for £250 will be put in the post today, started to get worried after MBNA had filed a defence, but hey presto cheque drops on the doormat .................... BIGGGGGG thank you to Martin and everyone on this website, given me more confidence to take on Barclays now
