And, once again, in writing they confirm the ILLEGAL nature of their punitive charge - a PENALTY and therefore unenforceable.
Despite warnings from several posters over the past week that they could not, by law, levy penalties they persist in repeating this, so much so that one can only read that they are happy to allow their agent (and, ipso facto, themselves as principal) to break the law.We are reviewing how the cark park management system works, which includes the issuing of penalty notices. We will continue to ensure we allow sufficient free parking time for Aldi shoppers and that time limits are clearly sign posted in all stores.
This won't look good before a judge if Aldi, as they seem unprepared to stop the PE juggernaut heading that way, allow any of their cases to proceed to court.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Aldi have every intention to abide by section 5.3.5 of the Transport Assessment. We can guarantee that any parents dropping off and picking up children at the adjacent Day Care Nursery will not be receiving penalty charge notices. Thanks for getting in touch.
