Saying its a punitive charge so a penalty, or some other specific reason is enough I think. If it went to court that is what your argument would be, it's penalty so should not be enforceable. I think you are putting to much into that. The wording is just to get the popla code and that's it.
And don't forget popla is still going on the strict 35 day rule
Is there a catch-22 here?
POPLA say if they don't reply within 35 days, they must cancel charge.
But if they don't give you the POPLA code, how do you get POPLA to act?

I did not have my disabled sign in my car at Asda.When I left I had a parking fine from smartparking .com.I rang them say day and they informed me that all appeals had to be dealt with by post or online.I appealed on the 20th of June using the online procedure.It has been 17 days and I now owe £70 and have had no reply what should I do.0

Who knows what they will do next? Ask them why you got no POPLA code if you cannot understand why not based on the dates when you appealed. Like I already posted yesterday. Your continuing dialogue over this might force them to give you a POPLA code and if not it's a reasonable question for you to keep asking.
And if their reply seems unreasonable, you can report them to the BPA and DVLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all.
Had a parking eye charge notice back in may but was told by my wife's sister who also in the past has had two of these to ignore them which i have i,ve not made any contact at all but the other morning the door bell went and it was a post man wanting a signature which turns out was a threatening letter from the leeches PE saying LETTER BEFORE ACTION so my question is do i still ignore them??PS i was parked in a disabled space i had two elderly people with me and i had a badge in window and i don't know the reason for the parking ticket.0 -
