won my esa appeal after 1 year 4 months of waiting got awarded 21 points but now :s

    sorry i dont know anything bout the dla so cant help u on that one
    yes the payments went in today(saturday)
    they went in as 4 payments as follows
    norm esa payment at the higher amount
    backpay of esa
    £25 cwp
    £25 cwp
    so glad its sorted now atleast for a couple of months till they send me the forms out again and im not sure yet when the first wrag thing happens

    won my appeal on 17th September 2012 after being on esa for a year, was called down to my local jobcentrefor a interview.(after the judge said she didn't want them to reassess me for 18mths,went in December 2012 ) they told me I wasn't entitled to anything as my partner works over 24 hours. the judge awarded me 6 points, atos awarded me 0 points.so what was the point of me winning my appeal to then get no money.waste of time. they should get all the lazy watsits that don't work and don't intend working off benefits before they penalise people like me that have worked for 37yyears and now get nothing.sorry if I sound angry but that's because I am


    But that's your opinion, clearly neither ATOS or the court believed you are ill enough to work. You are right insofar as to appealing, it is a risk.

    I am sorry you find yourself in this situation.

    Not trying to be offensive to anyone over the age of 45 who in the past couple of years claimed IB(ESA). The Guardian published an article two weeks ago where research showed a disproportionate amount of claims from over 45's for the former Incapacity Benefit (now ESA) since the recession. They also showed a higher proportions of the same failing ESA & their appeals.

    Ah so it went in earlier than u expected peanut-can i ask are you on income based esa or contribution based esa?
    If income based then the 365 day rule does not apply ( I have spent to much time researching all the rules and regs I think i have become obsessed with the whole carry on )
    I rang up yesterday morning for an update and the lady said 7 separate times it could be up to 6 weeks, it was quite funny as i kept saying i no that information i am merely doing a check seeing how things are progressing, 6 weeks 6 weeks 6 weeks like a robot hahaha.
    Any way its 3 weeks thurs since appeal and I am resigned to the fact it will be the robotic 6 weeks as its been drummed into my brain by the robots at dwp.

    sorry to the fello who did not get any payout maybe they should have better informed you about having a partner and how this would affect your claim before you appealed?

    I have no partner so i do not no the rules n regs of that side of things sorry :( try not to be angry, if you think you are entitled to somthing fight for it.

    im on income related esa so the yr thing never applied to me either.
    u heard anything from them yet?
    beacause if you get paid this friday your payment will of been processed on tuesday so you could always give them a quick ring to see how much is going in

    Ope u feeling beter

    I rang up yester day to get a ring bk from benefit office and the guy said he had released my 143pounds payment on friday n will need no more sicknotes so thats good but no further forward on the backdated money its one month today since tribunal yet they saying i as not put into a group untill 30th and that will be a month next tuesday- he said it might not be sorted till july and i lost my wrag hahhaahhaha sorry a little joke.

    no i got very cross and said its this amount this is the amount of cwp so can you just press the button as its not hard- he then said its a quing system and i have o wait a bit longer and i said i its not in in two weeks i am going to get my mp involved hy should the dwp have my money gaining interest in there acconts while i wait like a good little girl- he then said he would go up stairs to were the people are that press the button are and put in a good word!! so making a fuss does help then i said- he told me so much info then saying there is only people covering all the appeals and the rest of the people are just call ventre people with no training this is all due to cut backs and he has been there ten years and had no pay raise- dont think they guy was happy in his job tbh with you..... anywho i told him would wait a fortnight and then i am going to start causing a thorn in there side as i realise there is a huge work load but perhaps the govenment should have thought of that before they brought atos into the mix an caused this huge problem in the first place! x

    Frankly, I'm not too surprised at this. Since the 80s recessions there is plenty of anecdotes that Gov'ments have covertly steered older jobseekers (less likely to be hired) towards IB in greater or smaller numbers at different times in order to keep them off the long term unemployment statistics?

  • Appeal back pay has gone in :) 8 weeks to the day of my appeal :) in the post was a letter for my first wrag interview in 2 weeks time lolololol - so happy its finally over been a long year and a half wait :) thanks for everyone's support and constructive criticism both positive and negative- :) xxx
  • My esa was stopped in November 2011, I had no money at all until I could apply for a new claim of esa in march 2012, I have just won my appeal, I have been getting 98 pounds per fortnight, does anybody know if I will get the money backdated from November 2011 and how much back pay am I due as it's been 26 whole months waiting!!!
