it is luck of the draw i am doubtfull it has anything to do with correcy procedures anymore it's just down to luck you only have to read through the forum to see that as you will get 1 responce someone else will get a totally diffrent one from the same bank, it's ridiculous:rotfl: it's all making my head spin!!!!!!0

i assume you are talking to me?
i understand that it was possibly just unlucky that i got the wrong guy to talk to but what should i do now.
do i just sit and wait to see if they respond to my letter? or do i wait for them to send another letter after re-investigating it? he never gave me atime limit so how long should i wait to hear back from them.
or should i just send the next letter template moving on the court action?
thought things were going well but that phone call has made me hit a brick wall since i don't have any timescales to work on now0 -
my data request letter was signed for on 25th april however there is no evidence of the cheque i sent being cashed, the forty day time limit(not working days) expires one day next week.Should i call them?,go to the bank and be ignored again?,or should i report them to the FSA without further ado? I know what i would like to do but any help would be most welcome0

There hasn't really been 'correct procedures' as such. Just recommendations based on peoples knowledge/experience. Generally if the guides and templates on sites such as this are followed, people have been successful.
The whole situation is constantly changing and sometimes these developments come around quite rapidly. Everyone involved needs to react to these and come up with new strategies and methods going forward.
That's why it's prudent to read the forums thoroughly and have an idea of the principles of reclaiming and what it entails.
I don't believe there's much luck involved if you're well prepared and aware of what you're doing and why.0 -

i got a responce pack letter from halifax via mcol this morning woth a box ticked on it saying that they intend do defend all the claim?
this is on the acknowledgement form sent out to them, is this just the precurser to the defend or is this it?
also a senior judge has said which was reported this morning on the news on bbc that the courts are now a lottery, when i said this 2 days ago and yesterday i was told i was wrong it's just tactics need changing,
so i will ask again can you contact your bank by phone or letter if this has gone this far to ask if they will now settle out of court, because i really have only just been able to afford the money i have paid out to do this and dont really want it left down to wether a judge has got out of bed the right side or not or i live in the right or wrong area and lose even more money depndant on this, if this has turned from a real legal debate to what judge you have i feel it is a farce, now please dont just remove my post as has been done for a few i am asking a legit question and raising a relative point and this is now not just me saying it it is a senior judge and i think it deserves an answer or your opinion as i for 1 am following guidence as i dont know in's and out's only what forums like this say and the news, so please help:rotfl: it's all making my head spin!!!!!!0 -

sent letter asking for charges back on 30th May. received refusal letter back today (2nd June). Surely if they were that snowed under with requests for this then they would have took longer to get back. get the feeling they arent even looking into each case but automatically sending refusal letter.:mad:
Ringing them monday to ask for re evaluation. Watch this space....0 -

If you're referring to my previous response, I said I believed luck played a small part and I don't agree with this judge when he calls it a lottery in terms of the outcome. There are a number of different outcomes, but the vast majority still get their money back without appearing in court. If it did go to court, a well prepared case is still very likely to win.
In terms of overall numbers, if you entered a lottery with odds of 100,000's to a few in your favour, I think you'd be pretty confident.so i will ask again can you contact your bank by phone or letter if this has gone this far to ask if they will now settle out of court
You can still contact them if you wish. In fact the courts urge parties to settle out of court if possible. Whether the bank are interested is another matter.0 -

how can you say well prepared when some of the people getting thrown out are doing so with templates from here and have followed all direction given, now when i have asked politly for advise i do not wish for sarcasum as i am sure this is not what martin set this site up for it was to answer qustions to try and do the right thing by normal people who havent all day to sit and do nothing but focus thier lives doing this , we are just laymen and as such look for advise and guidence from people like yourselves who act as those who can do as such, so please can you refrain from sounding so rude to questions asked on here, i think i have a right to ask about this situation and the answer you are givinf seems to insinuate that everyone who is having thie stuff thrown out has just not done thier case properly or well enough , not all these people have done a beswick i am sure and are proberbly very scared at what is happening will you be standing in the court with them when they have a stroppy judge throwing questions at them? i think not now when this all started it was common place that a bank would not want to go to court and that if they didnt show it would get thrown out correct?
well that has happened twice now albeit that paperwork wasnt what it should have been now there are a reported 20 people who are having the threat of having thier cases thrown out [therfore another step that nobody was expecting] so what next at the end of the day you are not a judge you are not sitting in that court and cant read the judge's mind therfore you cannot say a well prepared case would very likely win because you cannot predict what a judge will say [as has been proven]
i did not join this forum to be talked down to patronised or any such like i joined as i admire what martin does and what he stands for and trust his judgement but not to get treated like a nothing and my opinion to be treated like nothing i can see a trend appearing and i dont think it is fair and if i do go to court i will bring up the fact that others get paid after a couple of letters others get a court date and paid early and that it mst be one way or another ,
as it turns out the fact that i have never gone overdrawn other than when the bank has put charges on my account and the fact that the bank allowed money to be taken from off by debit card without sufficant funds in the account [ illegaly from an online company i had used once and was notified about it yet they still let them ] and a few times what they did actually take was my disability money leaving me in a terrible state will proberbly go in my favour but unless i have a willing judge it will mean nothing:rotfl: it's all making my head spin!!!!!!0 -
Woah there.... This is a chat forum and not as Martin himself said to me an experts' question and answer board. Everyone who posts on here is a layman with their own experience be it large or small.
Both nickmark and myself are volunteers and don't have to answer the myriad of questions that are placed on here on a daily basis, our job in fact is to keep the board running smoothly and to make sure that people read the information that is given both in Martin's article and this board.
The truth is that both of us, and Rex_Mundi who is offline at the moment, spend an inordinate amount of time researching and answering questions on the board and via pm which is way beyond our remit of a Board Guide.
I could go on but I won't, if you want expert's opinions I'm afraid this isn't the forum for you but as you can see from Martin's thread when the chips are down he'll step in and see what he can do.0
