I'm in the process of reclaiming money from the Royal Bank of Scotland and have an inital letter on 6th April ay to say they're considering my claim. Having sent another letter am now in the MCOL stage, however, Royal Bank of Scotland address is in Edinburgh which means I can't use the MCOL. Is this right or is there some way around this. Thank you.0

Iave just been on to the phone to HBOS customer relations department - 0845 725 3519.
Told them I had today received aletter saying they were looking into my complaint. The trouble is I have not had statements yet! Has this happened with anyone else - what was the result?
Anyway, the lady said she would make a note on file to get them sent out - although taking a while cos of the amount of people applying. I asked what was there procedure and she told me the list they send me will be of charges - so you do not need to do anything as they have the same list. They then pass it on to the manager who decides which cases they feel need defending. The ones they do not defent they come back to with an offer!!!
Does this sound familiar???

I have had the opposite of your problem. I received my statements on 17th April and put in a claim on 19th April, which was acknowledged by the HBOS. However on Sat. 26th May, I received my statements again. I think their system must be in meltdown!!!!0 -

I've just had the same thing, apart from getting the letter as I decided to call again to see where my statements were! Went through to customer services on 08457253519 who told me to ring data request line on 01422391152 (which I would advise anyone to do - automated msg then cuts off) so called back through to customer services - being polite explaining what had happened! was then told that they are no longer sending statements out of the process was taking to long - they send off a defal (may not be correct spelling) form to the customer service manager who will then investigate and will take a couple of weeks. Tried advising this is all well and good but I still dont know what charges they have taken from me and as per information commission they have 40 to give me my information - (49days so far) so was told to ring the customer service section who are dealing 08451241330 have just tried but lo and behold office hours only! so will try tommorrow but not holding my breath!
Is this the new policy? And is this legal - wonder what Martin would think about all of this - no statements straight through to complaint!

Don't forget that under an SAR you aren't actually entitled to statements per se, you are only entitled to the data. It's up to the bank how that data is sent to you.Hamsters have no tact and diplomacy, nor do they want any.0

Hi. I recently sent a request to Bank of Scotland for £4000 worth of charges to be refunded. I am however worried that it will reach the court stage. Since in Scotland, small claims must not exceed £750, will I have to pay solicitors' fees out of my own pocket?0

Go the Financial Ombudsman router. It costs nothing and there's no limit to what you can claim.

Hi there,
A while ago I sent in a claim to the Halifax to claim my money back, and sure enough I got a response about 3 or 4 weeks after with an offer for less than half of what I was claiming.
So, not being downhearted I sent your follow up letter on the 27th March, and have heard nothing since.
What should I do now?
Do I contact a small claims court? if so how do I go about it and what are my chances as I now have received more charges (over £100 in one go).
