    It would seem like some of us are at a similar stage of our claim. I do not mind that they are only sending a list of charges as opposed to statements, as they aren't actually required to do so, however we have no way of checking these. As I was told that the Manager will analize the account to decide who gets offer etc, how can they tell from a list of charges?

    Seems a bit hit and miss to me!

    I was told it would probably be a few weeks. So lets see. What are their first time offers like?

    Hi There,
    I was going through the forum to find some info after being given a low offer and replied by letter. I had been waiting over a month, and saw your note.
    I called the number and got an offer for the Full ammount over the phone.
    What a result. Thanks a million.

    Hi,

    Just looking for some encouragement I guess:confused:

    I had sent off the two template letters and then received the pretty standard we think the charges are fair letter..........

    The I filled in the Financial Ombusdman form and I have also just phoned the bank to ask for a re-assessment ( I called the 0845 124 1330 number). The all seemed fine, I had to give my claim reference but the guy on the phone didn't actually say anything. Anyone else had that? He didn't say anything about timings so I now v.confused!

    Caz I've done exactly the same as you have done today, started with the FO and asked for a re-assessment. The guy was quite nice on the phone and said that I should probably get a more favourable response this time, they are using this as a stalling tactic. They have to have given you a reponse by 8 weeks and are getting around this by refusing to repay but allowing you to have the claim re-investigated. He couldn't give me a timescale either so good luck to you, I'll watch out in success stories for you and hopefully I'll get mine up there aswell.
    They took my signature away!!!! :confused:

    I feel like I have been doing this forever but I know I have done everything I can - I just can't afford to take it the whole way through the small claims court. I have my fingers crossed for you:o

    I received the standard refusal letter from the Halifax today so rang up the number on the letter and spoke to a very nice lady. I said that I was ringing as I had a refusal letter and wished to speak to somebody about it, she asked for my reference number (which you get on the refusal letter) and while she was getting my details up on the screen she said that what she can do is put this through to the team who will have another look at the claim, would I like her to do this? I said yes please and she said no problem, they will write with their offer (was this a slip up?!) although it can take up to 8 weeks. I did also say that I originally claimed for interest on top but would be happy to drop the interest charges if we were not going to progress to court stage and she wrote that down on my re-evaluation notes. So fingers crossed!

    I am hoping that being firm but polite is the way to go!

    Don't forget that under an SAR you aren't actually entitled to statements per se, you are only entitled to the data. It's up to the bank how that data is sent to you.

    I understand that and I did say to them I wanted a list of charges but didnt get anywhere with that either - just told it had been sent to the manager to investigate!

    Update however just spoken to main number 08457253519 and a very nice guy stated that I should never have been told this I would be recieving a list of my charges with 7 to 10 days of my phoning through regards my statements on the 24th! Along with a response to me claiming back my charges - so hopefully fingers crossed, although not holding my breathe! :o

    Hi all,
    Recieved the standard letter today and rang the number on the letter only to be disconnected each time, so I tried another number and spoke to the nicest man. He told me that when the staff at HBOS where told about this letter two weeks ago they all nearly fell off the chairs laughing, they told senior management this wouldn't work but they were disregarded. Apparently 1 in 20 customers dont asked for thier claim to be re assesed so they foolishly think they can recoup all court fees from this one customer!!!
    The young man said I would recieve an offer and no doubt would reject it and to call him back and he would discuss the full amount being repaid. When I asked if he was fed up with it all he said that they thought this would be ongoing till atleast mid 2008 and are totally bemused by the bank!!!! I also pointed out that the majority of charges I was claiming back where taken from me when I was going through a divorce and on benefit and that if it was taken to court I didnt think the judge would look favourably on the bank leaving a single mum with 3 small children with no money for food etc. He laughed and replied he would love to be a fly on the wall for that one and that if it comes to that let him know!!!
    Sorry long winded I know but what I am trying to say is be nice and remember most of them agree with us.

    Hi,
    I just called the number on my letter as i have had no response to my 2nd letter for 3 weeks now, even though i had put 14 days on it.

    I spoke to a guy to explain this and that i would like my case re-investigated.
    I was very polite but he didn't seem to be the chatty type (maybe he is !!!!ed off with all of these calls!)
    He just checked his computer and said after about 30 seconds that it will be re-investigated and that was it.

    So now i don't know what happens next.

    I thought he would be able to give me an answer as it seems that others here have got answers but as i haven't what are your suggestions please?
