Just has £1100 out of a claim for £2576 put into my bank. In the letter a paragraph states :
Finally I would like to explain what accepting this offer means to you. The offer is a goodwill gesture and is in full and final settlement of your complaint against Halifax.
To accept the payment take no further action and the money will be credited to your account within the next 14 days.
If you do not wish to accept our offer, please return the payment and contact me on the above number.

Is this where I negotiate a better offer ?

Just a thought. How can a goodwill gesture also be a full and final settlement ?

75% max settlement is policy now. It changed to this on Monday. If you want more you will have to go via the court route, where you may well get 100% plus interest and your costs back. Before you do anything, check on here how to do this / or go to the Ombudsman, look at the various threads and links on MSE and the bank charges forum. I find the search function is really handy to get as many useful threads as poss.
IM claiming the interest through the FO And have been offered another 384 of the 985 they owe me , just sent off the decline offer reply to them ...
    Im not really mad...

Halifax have told me that i have to wait 8 weeks, from the time i recieved their acknowledgement of my 2nd letter??, surely this can't be right.

I'm lost as to what to do now.....do i wait another 8 weeks?? thanx x

Probably. The eight weeks seem to be standard now. However on a brighter note, as soon as that period was up, I called the 0845 number and spoke to 'Mike'. He seemed really nice and confirmed that the eight weeks were up that day (Wednesday). He advised that he would escalate my case immediately and that I should hear from them within 7 days. Just twenty-four hours later (Thursday) the cash was in my bank! I had claimed for £1647 based on 6 years of charges and received £1341 (equivalent to 5 years of charges) without any haggling. As 5 years is the actual claim period in Scotland, I'm very happy with that. :D
  • finally got my letter this morning so called the number and had my case reviewed and they came back with an offer of 81% of my total claim (inc interest) or 97.5% of my charges only, so I have accepted this.

    good luck everyone.
  • It's over :)

Just got my offer through this morning. On one account I have been offered full charges and interest, the other I have been offered half the charges and interest total. I am delighted and, after almost jacking it in on more than one occasion, I am glad it's all over.

There's been a few depressing days throughout the whole process (anyone who has read my posts will know how close I have been to jacking it in) but I would just like to say DON'T GIVE UP. I nearly did but now I'm glad I took the advice of all you good peeps out there.

Thanks to Martin for this fantastic site and everyone who posts on here and kept me going even when all seemed lost. :)

Hi there everyone, I am new to this post thingy, so please bear with me!

I am a bit confused as to what to do next.

I wrote to the Halifax using Martin's fab templates asking for a list of my charges, I received a letter back stating that I had only had 3 charges applied to my 2 accounts in the last 6 years, which wasn't right at all! I rung them up and a very nice gentleman apologised and I received the correct statement within 2 days. I sent the first letter asking for them back, to which I got the standard no way letter back. I then sent another letter back to them on the 25th June threatening court action if I didn't get the money back. I have not received a response since. I rung them on Monday and a lady said that my letter was still in the queue and that she will try and get it pushed up the queue. I still haven't heard anything and rung them again today and the guy that I spoke with just babbled on and said it still hadn't been looked at, he said he will email his managers and then get back to me.

I don't understand how they still haven't looked at it and yet reading all the success stories on this website for Halifax cases, there have been people who have had responses within days after sending their 2nd letter threatening court action!

    What can I do??

    Thanks for your help.

I don't think you have blown your chances, you will have to wait out until you hear from them.

If in your 2nd letter you said you would go the courts route I would just follow what you siad. I did this and when i got the offer letter from HBOS and spoke to them and told them that as i hadn't heard from them after 28 days and i had submitted a small claims court they settled with a higher than average offer with a couple of hours.

    good luck
