    ive just rang them and they were great explained i hade recived a letter declining my charges and i had sent another letter and was just wanting to make sure they had recieved it she was really nice and said it was in a queue to be sorted but she would note i had rang and try to push it through for me and i should recive a response soon :j

  • I have just recently read the thread about the declining letter, which I have also received from the Halifax (but only after a second letter stating that I would be taking it further!), so i took the advice and telephoned the number given and low and behold without any questioning and almost as if it were a recorded message (!!), a very nice chap said that is fine and that it will be sent requesting re-evaluation and that I should receive an 'offer' after 14 days!!!!! So we shall wait and see!!!

    While writing, I could do with a bit of help - still with the Halifax - when I originally sent off my reclaim letter I put my account and credit card charges on to one request but clearly marked as to which account it related to etc. So first off I got the decline letter for my account and within days I received a letter regarding the credit card charges with an offer of half the amount (£85 without interest, total including interest £214.18), they said they cannot pay the interest amount unless it is through a County Court - is this right? Although not masses amount of money - is this the time I now send the letter advising them that I will going to court etc and see what happens? Any advice greatly appreciated to ensure I do the right thing!!

    Yes thats totally right - you are not entitled to interest unless you go through and win in court . Yes again send them a letter stating that you will take them to court unless they respond satisfactorily within 14 days. Hope this helps

    Fergal, I received an offer from HBOS yesterday of £1,100 (50% of charges) when I rang to decline the lady upped the offer to £1,650 (75%). Again, I told her that my charges were £2,200 and a court cost fee ofd £120 and that I'd happily settle for £2,320. Was told that £1,650 was the highest she could offer. I informed her that I'd continue with my claim through the courts (only 6 days until I can request Judgement By Default). Good Luck

    Hi there

    I have been claiming a total of £1668 from HBOS, after a lot of chasing with them I finally received an offer of £828.50, which is half of my claim :eek: . I rung the Customer Relations Team this morning and spoke to a very nice guy called Ian.

    I thanked him for the offer :T but said that I couldn't accept it. I advised him that the minimum I would accept without prejudice was £1250, which is what I had put in my letter. He said that he could then only go to about £950, I apologised again and said that that wasn't high enough, and joked with him that this was like playing Deal or No Deal and he was the banker, to which he was laughing as well. I told him the absolute minimum that I could accept was the £1250, I finally accepted £1235.:beer: :j :T :rotfl: :A

    So I am just waiting the money to be paid into my account, at long last!!

    Hooorrrrrrrrrrrrraaaaaaaaaaaaaayyyyyyyyyyyyyyyyyy!!!

    It will take time, but I definately think that they just offer you half of your claim at first, just keep pushing them but nicely and they will eventually give in!

  • I successfully claimed Bank Charges from Halifax, who acknowledged the claim but paid the amount, explaining it would cost them too much to go to
    Court to defend. Whilst the moneyclaim court proceedings were in progress Halifax
    continued to add unlawful charges £39 a time which amounted to £600 in one month. My letters of request to refund these further charges and a breakdown of how Halifax calculated their charges were ignored, so I had
    no alternative but to claim again via moneyclaim. Successful again, with
    explanation from Halifax that it would be too expensive for them to defend
    the case.

    However I have no access to my account. Halifax want me to take my cheque book and debit card into the Branch. I asked if I might have cheque for
    the full amount in the account. The telephone conversation I have had with them today is that once I have handed in my cheque book and debit card
    and I request cheque, it will take ten days to clear. Is this usual? Does it mean they have already decided to close the account? If so why can't a cheque made out to me be cleared sooner than 10 days. They have asked me to inform the Court that they have paid the £600 claim but since I have
    no access to the money, can I request daily interest until I can actually
    have use or contact with the money in the account. Thanks.
  • getting somewhere at last after 1 week of sending the court threatening letter been offered 50% as a good will gesture will be credited to my account in 2 weeks should i just accept or tell them no i want the full amount i am only claiming £234.

    Hi everyone, this post is almost exactly what has happened to me, but I've only received half and the rest is now overdue I think so I'm wondering if I'm actually going to get it...

    The letter with the offer of £813 (I was claiming £1596) was dated Friday 29/6 and arrived nearly a week later. I typed up a letter over the weekend declining the offer as I'd issued a claim on Tuesday 3/7 but on the Monday 9/7 the £813 had already been paid in.

    So I rang the customer relations guy and told him I was declining it and to take it back, he upped the offer to £1550 so I accepted. He said that instead of taking the £813 back and paying the £1550 in one go he'd just arrange for the difference to be paid (£737) within 14 days...which should have been paid in by yesterday unless they mean 14 working days? Or have I been tricked into accepting the first offer? I haven't stopped the court proceedings yet though, the court have said not to drop the case until all the money is in my account and the acknowledgment of service was filed on Wednesday 11/7 so I'm in limbo now:confused:

    They have to pay you the sum you have both agreed on. They have failed to do so in the timescale agreed. So are in breach of that. You need to speak with the person in C/Rels and remind them that they have made an agreement with you and if they fail to keep to it, the court will take a dim view and they will incur expenses, interest... use all that. in the nicest possible way of course ;)
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....
  • I just came home and found my first rejection letter (boo hoo) from Halifax for my Current Account. From reading this thread im planning to give them a call tomorrow. Apart from being funny and charming when i ask them to re-evaluate my case should i mention anything else.

    I'm only trying to claim just over £400 and that's without interest. That's not alot is it??
