    75% max settlement is policy now. It changed to this on Monday. If you want more you will have to go via the court route, where you may well get 100% plus interest and your costs back. Before you do anything, check on here how to do this / or go to the Ombudsman, look at the various threads and links on MSE and the bank charges forum. I find the search function is really handy to get as many useful threads as poss.
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    Well, it looks like the ball has burst on getting nearer to 100% back by phoning for a re-evaluation, however do remember that 75% in your bank now is no bad thing if you want to avoid filing a court action.

    Have a read of Martin's article regarding taking court action or going through the Financial Ombudsman ...

    Hi,

    Typical, i receive on offer on the tuesday and they have changed to only give 75% on the monday.

    Oh well, 75% is better than a kick in the teeth :D

    I thought all my hard work would actually be getting my money back in the first place but it seems to be actaully getting it in my account.....getting v.tired of it!! I received a letter from the FO yesterday stating that they had sent my acceptance to the bank and that I should get my money soon if it was not already in my bank. It's not in my account so I phoned the bank today and the nice lady said it was with a reviewer who are looking at 500 acceptance letters a day and that she knew I had been waiting for ages. Hopefully within 3 weeks..........please someone tell me it will be sooner?!

    Hi all I live for reading these forums!!
    Well, Ive just come to the end of my reclaiming from the Halifax.
    I received aletter from them today offering me 50% of the £3026 I was claiming - £1532.50 without interest.
    I rang the 01977 number and spoke to a very nice man who put me on hold and came back and stated that the maximum they could offer me was 75% -£2298 as the rules have changed.
    I stated it wasnt enough and i was still going to go down the court road so he advised me to take the 50% and try to sue them or take the 75% and leave it at that.
    So after thinking about it for a couple of seconds I agreed on the 75% which he said would be deposited in our account within 14 days.
    I am now unsure wether or not to try and sue them for the remaining money £1221. (inc interest)
    Some advice would be good!
    I am quite happy with the £2298, it will get us further out of the hole we have dug ourselves into. (and it will get me a new dishwasher lol)
    I would be very interested in what any one else has got to say on this matter!

    Halifax have told me that i have to wait 8 weeks, from the time i recieved their acknowledgement of my 2nd letter??, surely this can't be right.

    I sent my first letter in 26th march requesting bank statements..i waited until 14th June to recieve my statements, they sent me full 5 years every day for the next 10 days....wats that all about????

    Second letter i sent on 14th June requesting my charges back, they wrote back 20th June say no i can't have them

    Sent 3rd letter 26th June saying is you don't give me them i'll take it to court, i gave 2 week limit on this

    I heard nothing so i called and asked for them to be re evaluated spoke to a really cheeky lady who told me "not to be so silly", that i have to wait 8 weeks as from 20th June (when they sent letter), They can't possibly get back to me in 2 weeks...... "so u'll just have to wait Mrs Mullan", she said!!!...

    I'm lost as to what to do now.....do i wait another 8 weeks?? thanx x
  • I'm wondering if someone could offer some advice. I wrote to Halifax reclaiming my bank charges. I got the standard refusal letter within a few days. So I replied saying that i wasn't happy with their response, still wanted my bank charges repaid and if they didn't respond I would go down the County Court route. So after no reponse (I gave them 28 days) I submitted to the small claims court.

    This morning I check my account online and some random cash was paid into my account, on checking it appears to be a settlement of bank charges. However the letter was sent out on the 17th stating that they would only pay back £275.50. I haven't as yet received this letter (the wonders of Royal Mail). So without waiting to see if i was willing to accept the amount,they have paid it to me anyway.

    I have spoken to some on 0845 124 1330 and their advice was to call the number on the letter and dispute the amount and negotiate a higher settlement.

    My question is that I have now paid court fees, should I accept 75% (if they offer it to me) and ask for the £80 fees? Do you think Halifax will pay the fees? or should i just keep going down the court route seeing as i have paid for it?

  • 75% would be an excellent offer in my opinion. In fact, I would be grateful of ANY offer.

    After getting nowhere on the 0845 number, I decided to start using 01977 627422 and seemed to be getting somewhere with it. Originally I was told I would have an offer within 2 weeks but to phone back the next week to check the progress. Phoned one week later (Monday past) and was told the review manager had dealt with my claim on Friday and an offer was "in the post". At the end of the conversation, I double checked this: "...And you said my offer is in the post?", "Yes", she replies. So I decide to cheekily phone up again yesterday since I have not heard anything yet. I get a guy this time. When I ask him the progress of my claim, he says "we have your letter of the 20th June, I will make sure a review manager looks at this today." When I tell him I was told an offer was in the post, the line went silent for a few seconds and he says "I don't have any record of this but I will chase it up for you." !!!!!!??

    Anyone else been messed around like this? Just when I thought I was getting somewhere, it's all gone wrong again. I'm starting to think it's just not meant to be.

    when u phoned the 01977 number what did you say?, as i have called the other number and they were kinda rude!!...think i'll call that number today but not sure what to say?? help please!!
