    I'm just wondering what to do next, the bank have another 10 days to reply to my threat of court letter, if the response is negative do i phone or do i just go straight to court? So many of you do different things and i want to do whats quickest i'm claiming 1170.00 inc intrest. Any help would be great.

  • I have just recieved my requested list of bank charges, however as this took longer than excpected i had phoned halifax up to inquire why it was taking so long. The guy said it would arrive next week, but said in order to speed up process he would start my complaint. I said fine so now i have my statements AND a letter declining my case. WHAT SHOULD I DO NOW? Shouls I write the 1st letter as tho have never recieved declining letter? Should I phone asking to re-evaluate case? Or should I just skip to say that am not happy and have no choice but to threaten with court action?? :mad:

    Any help on the matter would be greatly appreciated!
  • I'm currently claiming just short of £500 from the Halifax and I too have got the 'sorry' letter. I phoned them at told them of my displeasure, and said that I have been with them for 20 years. Guess what they are re-evaluating my case and should make me an offer 'in the next few days'.
    So, dont give in, get cracking!!
  • Hi all - many thanks for the advise and help on here. I have been doing my Daughters calim with her since early April, and was disheartened when we received the standard HBOS knock-back letter. Initially we left it for a few weeks whilst on holiday, and to decide what to do next. I then came across this thread and the revised action of asking HBIS to reassess the claim.

    She did this in mid June, and since has rung on a weekly basis. This morning she rang and was told an offer of £350 had gone out on the 6th (but we hadn't yet rec'd it). She rang back and said she wasn't happy, was asked how much she was after. Told them it was the full amount, and they said okay and agreed to the full amount (including interest) of £627.

    The money will be paid in full in 14 days.

    To be honest the initial problem were all caused by HBOS and their tie up with their credit card company. My daughter gets paid last day of month. Halifax set up CC payment (direct debit) for 29th of month. Daughter protested and asked for payment to be changed to 1st of month to solve the problem. They kept saying they would change it but didn't do. The amount overdrawn was always less than £1, but turned into good earner for them or so they thought.

    Time to turn attention to her credit card now, and number 2 daughters account.

    Ring be nice and ask for a re-evaluation as receiving both together you feel the case was not looked at thoroughly?

    You need to back your phone calls up with a formal letter. Yes I would use the 1st letter and attach a list of charges you are claiming back. Give them 2 weeks. Then do the next one if need be (letter before action) and give them 2 more weeks, making it 4 weeks in total. If by then you have not had a satisfactory offer in writing or over the phone, consider Court proceedings. I would not take any less than 75%. But that bit is up to you. Good luck.

    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.

    That's the spirit! They will make you an offer. But be aware that they are all authorised to pay up to 100% (if they have to), but you will need to really push in a nice way of course - the way you have being doing. Good luck!

    On the or around the deadline, you could ring them and press for a high % settlement or you go to court. That may work. They can pay up but will make out they can only pay you 50% maybe. Don't be taken in by that. Be as nice as you can. If you wanted a quick settlement, ask for a % you would be happy with. haggle and see how you go. At least you know you have further recourse via the court or ombudsman if they won't deal.

    They do have a backlog. This may be of interest to you.... The staff there are not on money saving targets. They are under pressure to clear x amount of claims per day to comply with the regulations. They can settle in full with you. But that depends upon who is dealing with your case. Try ringing once more. haggle and see if you can get the % you want. Otherwise it is time for you to lodge your court claim. Lots of info on this forum / MSE on what to do. This may well force them to make a good offer.

    Guys,

    I got a call from Halifax friday and they offered me £748 just over half of what they owed me but I said no and I got off £1200. It was paid into my account yesterday.

    So today my credit report will be showing two more satisfied on the report! :T

    Keep persuing people its worth it in the end!
