If in your 2nd letter you said you would go the courts route I would just follow what you siad. I did this and when i got the offer letter from HBOS and spoke to them and told them that as i hadn't heard from them after 28 days and i had submitted a small claims court they settled with a higher than average offer with a couple of hours.

    good luck

I've been claiming back from Halifax on behalf of my dad. Where we heard nothing from them after the threat to take to court i began court proceedings on 2nd July. We then received a letter to say that they were transfering half the charge amount into his account and to call to get it transferred back out if this was not satisfcatory!!! After about a week of calls and explaining that court proceedings had already been started were wre had no reply in teh time frames set out we received a letter to say that were now transfeering the remianing amount + interest + the court fee. A total of 4361.56. Very happy with the result. Checked today and the money is in the bank - Dad's now looking forward to seeing family overseas with no money worries. Well worth sticking to time frames given. Good Luck:j
  • Hi All I have just received an offer of approx half of what I,m claiming just over £1030.50 my original claim is for double plus interest. I,m not happy with that offer as the Halifax really put me through hell and I want to get the most I can out of them, whats the best form of attack to take next?
    All advice greatly appreciated.

I got £2500 back from smile without any hassle at all:D

Mandy, I sent that letter to

    Halifax plc
    Trinity Road
    Halifax
    HX1 2RG

...and also a a copy to my local branch. Not sure that is the reccommended address, but they certainly got the letter anyway. :D Good Luck.
  • i wonder if anyone can help me i sent a claim to halifax for £1744.00 without interest which amounted to £2103.14 with interest.
The first letter i got was one declining my claim so i rang them and it got reviewed friday 20th july 2007 i got a letter saying they would pay £929.50 as a goodwill gesture.
So i rang customer relations asking if i could speak to the manager and she said was it to negotiate the offer which i replied yes he's supposed to ring me back on monday 23rd july 2007.
My question is do you think it is a reasonable offer and accept it or would you try and negotiate i just don't know what to do i think they could offer a bit more really.
    help please i'm stuck.

my advice would be to not accept less than 75% of the total amount of £2k which is £1500 at min(if claiming interest too), remember it might take a bit longer but you can refer it to the financial ombudsmen who in most cases WILL recover ALL of your money plus charge HBOS £400 for the pleasure!

    They are trying it on,
But at the end of the day its your call.... It depends on how militant you are feeling , they took your money without your consent probably at a time you could ill afford it.
The least you want it a refund of all charges minus interest and their offer is still a good way off that.

either way its still at least £1500 and they are way off the mark, they are trying to save themselves money..which in actual fact os your money they have taken.. they just dont want to have to give it back!!

Typically how long is everyone waiting to get their money after they have accepted an offer? Letter states within 2 weeks, is this another instance where they will leave me hanging on as long as possible?
