I spoke to the kind graham from halifax who got things moving and made me an offer over the phone of £1600, not budging on the interest though which I had hoped for, what does anyone think about that?
Hi there moneydaft.....I think you can only claim interest if you actually take things to court. If you can be bothered with the hassle of that. When I asked Graham to give me the full amount...I knew that this would be minus interest....and to be honest, I really didn't want to go down that route. I was SO happy and relieved to get this amount and without the haggling. It was only seeing Martin on TV that I realized I too stood a chance in getting back these charges> It depends on you tho ultimately....do you really want the interest or would you be happy to get at a bigger figure without the probs ?? Good luck tho!!!! As my name suggests....I can now breathe easy!!!!!!!!!

    Hi - need some advice!!

Recently called for a re-assessment upon receiving the usual rejection letter for 2 different accounts. My problem is that they sent the list of statements however a 6 month period of 30/06.03 - 31/03/04 is missing. They told me on the phone that this period is not showing up on the system either and is therefore during the changeover period. How can I then assess what my charges for this period are? Is this acceptable? If they make an offer can I ask for an extra llowance for this period if they cant provide the info, based on an average of previous charges, or should I report this period to the FO?

They have told me an offer should be with me around 16th July - but he has put another request in for this period of charges (again).

I just want to say to everyone DON'T GIVE UP. I nearly did a few times (especially when it got to progressing to the court stage), but am now VERY glad that I didn't.

I started chasing my charges in Feb 07. I had to request details of all the charges twice & didn't receive them until April. I requested the charges plus interest back immediately and received a fob off letter ("...satisfied that the charges have been correctly applied to your account.."). I then sent letter threatenig court action & received yet another fob off letter suggesting I contact the Ombudsman (this is now into June!). I instigated court action on 4th June. HBOS had 14 days to respond. On the eve of day 13 they Acknowledged the claim (which gave them another 14 days to respond). Having read all the other threads I was tempted to phone them and negotiate, but decided that I may win by default if my claim was 'forgotton' in the pile of other claims. I sat tight.........
Yesterday I received a letter stating that due to the cost of defending the claim Halifax would be reimbursing the full claim, plus interest and court fees. they will be paying it directly into my account within 5 working days. Hooray!!!:j

I am just going to wait for this to happen before stopping the court proceedings and then I'll celebrate fully!
Thanks to all who have contibuted some great advice via MSE.
  • Hi all

I have been following this for a while now and initiated my claim to BOS on the 3rd of April. To cut a long story short I have received my statements, made my claim for £4,357.00 (excluding interest) and received my rejection letter 2 weeks ago. I called the number at the top of the letter (08451241330) and asked for my complaint to be re-evaluated. I am just about to call them and ask what the latest is. Am I best phoning the same number again or can I call the "magic number" and ask Graham etc to look into this for me? He seems to be getting things done but I wasn't sure if that number was just for Halifax customers or if BOS customers can call it too??

Also, I have received some charges in the interim period and intend on asking for them to be added, am I best doing that now or wait till I (eventually!) receive my derisory offer letter?

Another thing that occurred to me is if they refuse to offer me my full amount I intend on using the FOS, can I add interest at this point? I didn't want to do it initially but if they mess me around then I want the interest too.

Thanks in advance for any help

    Chris

    Hello all.

Received my rejection letter last thursday, rang for re-evaluation. Had a goodwill offer of £3781 (claiming £6495). Thought i would try my luck and try for more. Rang the number on the letter 01977 627310, spoke to a young man. The amount I am claiming £6495 (without interest). However when he asked how much I would accept I said "the full amount without interest", having received some charges since sending the letter I waited with baited breath......"would you accept £7114" Yipeeee. Looks like they are adding on any other charges If you word it correctly and don't ask for a specific amount.

Thanks to all on the forum for your help and enthusiasm.

    A happy banker.

    Hi guys.

As I'm still waiting to hear back regarding my re-assessed claim, I thought I'd give a wee ring back to see what the state of play is. Do all the numbers essentially deal with the same claims? That is to say, I originally phoned the 0845 number, if I wanted to phone the 01977 number, are they able to carry on with the complaint or am I best to stick to the same number I used before?

    Getting desperate now.

I have tried loadsa numbers in the past some have said to use the number at top of the letter, but when I rang it i couldnt get through so I tried a different number was told i needed to speak to the person on the letter than i tried another person and got through and they offered to sort it out as I couldnt get through on the number I was supposed to. 01977 is definitely a good choice.

These are the numbers I have tried.

    0121 234 1068
    0191 235 7810
    0845 124 1330
01977 627422 this one sorted it in the end, however i went via the ombudsman and they said to halifax to settle in full! and they did but no interest.

    Hi Turboshandy

I asked basically the same question a few posts above but was too impatient for a reply so phoned one of the 01977 numbers anyway & the guy (Neil Baird) dealt with my enquiry so you should be ok
  • call the 01977 number ...i called it on Friday and spoke to Ronnie.....he said that he would get an offer in the post.......and true to his word i received it this morning i then called the number back and declined the offer as it was half of my claim without interest.....i was then asked what i deemed to be a fair offer i said the whole amount and the lady spoke to her supervisor and total amount has now been offer and i have accepted it.....i have gone down the court route but am too chicken and skint to wait to see what happens
