hi hope someone can help or give advice
i am trying to reclaim £700 (including interest) from Abbey, they delayed me for two month but i finnally sent a letter two weeks ago stating that if they didn't refund i would take legal action. I recieved a letter a couple of days ago from them saying they wouldn't give me the money and that the charges are lawful...what do i....do i still press a head with small claims court...is this just scare tactics from them.

Only just joined you clever lot and I have had my ball rolling with halifax for few weeks (now at point where I register online to take to Court) But based on all the chats on here It would appear I phone them and ask for a revaluation. My only concern is my costs amount to only £147.00 but based on some recent events with over drawing. It could well be much higher if I ask them to send all statements over last 6 years or would costs outweigh what I would likely get back ?? Any ideas??0

I've just had nearly £2,000.00 put back into my account yesterday which I never dreamt I would see again!

Worried now.
I got my decline letter 2 weeks ago. I phoned up straight away to ask for my case to be re-evaluated which I was told wasn't a problem. The guy I spoke to was chatting away and said that i would receive an offer of c. 50% of my total claim within 2 weeks yet I haven't heard a thing since. Sounds to me like they have forgotten all about me, either that or they didn't really re-evaluate my case. I'm reluctant to phone back as I don't want to appear pushy or desperate (which I am!). Reading some of the cases in here, folk have been getting letters/payouts within a matter of days of phoning for re-evaluation.
Anyone else been left in limbo like I have? Any advice would be grately appreciated.0 -

I phoned up on thursday as i was told the previous frid i would hear on the tue at the latest which i did not.When i spoke to Ronnie on thursday he said someone was looking at my paper work as we spoke but then he said the same thing the week before.Anyway he said i should hear tue or wed this week.I would phone back up and just ask what stage of re evaluation they are at.:rolleyes: Jan grocery challenge £300/£210 spent so far.I can do this:T0 -

I am trying to see if anyone knows any successful tips to help me progress my claim. I wrote to Halifax on the 10th March asking for my information about bank statements etc and they never replied within the 40 day limited ( it was 52 days but whose counting) I complied a list of my charges and it totalled £3323.12 with interest for my account which halifax actually closed because of these charges. I have wrote to them asking for them back and recieved the standard "go away" letter but I have carried on the process and given them the final demand for payment before court action and the 14th day for responce was today. What can I do. I have tried calling the 01977 number but it is never answered it just rings out then cuts off. The people on the standard number just tell me that a settle ment will me offered within 8 weeks but I dont want to wait and could do with the money now if I am honest. I have to say that I really do have a problem with Halifax anyway as they have bit information on my file there saying that there is a risk of offering me a full current account even thought I have paid over 70K into my account in the last year. The bad information is regarding bank charges that I paid on the account that was closed. What can I do?

I don't think there is much you can do, even if you could do with the cash right now, you will have to wait.I too had my acc. closed because of the charges and also received the standard go away letter. I also advised of court action, but that was ignored. The banks get 56 days to give you an answer and told me 'we're investigating it get back to you in 4 weeks' then another letter saying they needed another 4 weeks I then got my answer on the 56th day NO. My claim is now with the FOS0 -
Finally I recieved an offer 50% of my claim, together with my bank statements on the 29th July. I started all this on the 12th April, anyway better late than never.
In addition the Halifax provided me with TWO other couples full bank details and very personal info including roll nummbers, account numbers, sort code address's etc, How kind? I dont think either the ombudsman or the people involved will be very impressed! Luckily they have come to an extremely honest person, so I will send on to the correct owners. But does make you wonder how competent the banks really are!!! God knows what could happen if that info got into the wrong hands!!
I also recieved a letter from the ombudsman saying and I quote:-
" we have written to the halifax and invite them to:-- Make an offer that meets the claim in full: or
- Provide the ombudsman with information they believe they will need to reach a conclusion on the merits of the claim."

Don't panic mate.
Many, many thanks for all the help and assistance from everyone, just reading through the threads and posts and realizing that it's happening to everyone gave me the confidence to have a go. And thats what I did. I had a go, no idea what to do other than follow what everyone else had done, learning from others' mistakes and helpful advice. And just 2 minutes ago, HBOS have agreed to pay me the full costs of £468 (they originally offered me only half of it) and I realise that the offering "half the money" thing is just a stalling tactic, but I really feel like I've achieved something. And I'm just so pleased that I've got my money back. And I'm not resting on that either, now I've got some fire in my belly - I'm going for my credit card charges too.
Think I'll start a mexican wave to celebrate! :j :j :j :j :j :j0 -
Has anyone got a different number in Newcastle other than 0191 235 7810, cos this one is constantly engaged!!!! No one else will speak to me on other numbers!
