He then offered me £1275 which is the amount without the interest (interest of £174) so Ive accepted that, I know I may have got more if I argued but I thought Ive started with nothing £1275 is fab for a couple of letters being sent and 2 phone calls dont u think? He said I should have it in my bank within 3 days. Thanks for your help!!!!:T

Woooohooo!! I'm so happy for you :D Doesn't it make you feel good :j

He basically said the same to me, they offered me £1,329.00 and I rang and said I wanted £2,600 (£19 less than the total amount excl. interest) and he said that it would have to be re-evaulated then and I insisted that it was done on the phone there and then as I didn't want to waste anymore time on it. He put me on hold and apparently spoke to his manager and then offered me the £2,600. I was so pleased with how I could be so polite and firm!

I'm really pleased it's worked out for you. I got the original offer put in the bank yesterday and still waiting for the rest, so keep your eyes out in the next couple of days and you should get at least the original offer put in then hopefully not too long before the remainder gets credited!

I've already paid off 3 of my debts today, I feel like a weight has been lifted! Now I'm gonna ring a couple of gardeners and get them to sort my [strike]jungle[/strike] garden out, patio, play area, the lot!!! :j

sorry this is not a reply more advice, has anyone sent the letter offering a settlement, i have asked to reclaim charges and was just looking at next stage where you can offer a settlement, in it it says name of court, do you approach the courts first the send it or does it just mean county court or obudsman, also have many people had their accounts closed i am a hsbc plus customer, i have not set up a parachute account as you have to commit to paying in x amount and i do not want to close my account while this is ongoing as it might make it more difficult to claim

I sent off my letter on the 1st May requesting my staements within the 40 day limit. The 40 days past without recieving anything other than a letter confirming I would recieve them within 40 days. I phoned them up and they apologised and said they would print them off there and then and I would recieve them within 7 working days...still nothing so I phoned them today and they said they would make it urgent and the lady said she would get them printed off right away but couldn't tell me when I'd recieve them. It's driving me mad now I can't even get past the first hurdle. Should I now report this to the information commisioner or what other advice can anyone give me. The number I'm ringing is 08457253519 customer relations. If do report it to the information commisioner how do I go about it, I've gone to the link to the information commisioner but don't have a clue what to do when I get there.

    Halifax Bank
    Amount claimed £876 + Interest
    Amount paid £876

Started Claim beginning of April..Got the standard decline letter at the End of May. Phoned to ask them to revaluate my claim beginning of June and was told anything up to Eight Weeks. Rang a week later and got told it was two to three weeks to expect before a decision made .

After reading threads on this site I did the obvious.......I phoned Graham last Tuesday and was told by the very nice gentleman that he'd get an offer out in two to three days.

Saturday 23rd june...received 50% letter....phonedtoday and spoke to the Gorgeous Graham and bartered to the £876. Apparently he has been looking at this site over the weekend and is slightly embarrassed.

May I thank all on this site for their advice and also if you're reading this...THANKS GRAHAM :T I know you are just doing your job but the manner you use and the way you have dealt with us all is second to none.

Keep the faith all you who are still trying !!! It'll be worth it

PS. It shortens my debt period by 2 months roughly !!!!!

    Thanks turboshandy - will do!

If it should come to the next step, will you go via FO or court?

I also am confused that they are referring me to the FO, almost advising me to do so!
They would only do that if they think it will work in their favour, right?
That makes me think I have to admit, that maybe court is the better option?
My claim is over £5000 (inc interets though).

To be honest, I will most likely go through the FO, I don't think my nerve would hold going to court myself. The guy on the phone did seem to think I would be made an offer though so I'm just thinking about that at the moment. I'll worry about the next step if it happens.

My claim is £2600 including interest, although, if I'm honest, I would settle for £2000 as, at the end of the day, anything I get back is money I thought had gone forever and £2000 will clear the last of my debt.

    Hi there

I am trying to claim back £1660 from the Halifax Bank of Scotland. Eventually received all the charges statements, after sending 2 letter to them and having to make a couple of phonecalls. I have received the standard "sorry you have complained, but according to the terms and conditions all the charges should have been charged etc" standard letter  and have now sent off my second letter to say that I want all the money back or else court proceedings will take place, but...... if they do not respond and I have to start court proceedings, as I live in Glasgow it will be the Sheriff Court, but am not sure about which forms are to be completed. The small claims maximum is for £750, then there is another set of proceedings called Summary Cause forms but again the maximum for that is £1500!! Can anyone in Scotland who has gone to court please help?

Touch wood I won't be needing to go to court as they will pay out..........but knowing what they are like!

    Jo
