    Slightly different situation,i settled for £3000,paid into my frozen Halifax account like yours,outstanding overdraft automatically paid,obviously.But the remainder still froze as i had accounts in default with BOS,currently on a repayment scheme,so they are taking the remainder and splitting it between the two,leaving me with 0.Hope this sheds a little light.

    If you claim back more than you owe them and the account is closed they will pay the remainder to you by means of a cheque unless the account is reinstated for you once you have cleared the od

    I'm in the process with HBOS - just received letter of refusal, will 'phone them on Monday, Im chasing in excess of £3k !!!

    Anyway, my very friendly local branch staff, advised me when I collected my statements - free of charge - that if you write and request a breakdown of all the charges levied against you, they will do the donkey work for you.

  • Got the letter through the post yesterday saying Bank of Scotland will not be refunding my bank charges, claiming after investigation they feel the charges are fair and have been applied correctly.

    Phoned the number on the letter, was on hold for around 5 minutes or so before getting a very helpful guy. I asked 'if it was worth asking them to re-evaluate my claim'. The guy said it was always worth asking and put my request through. I then asked if he'd had a lot of requests and what the likely outcome would be. He said he'd taken loads of calls on it and every case that has been re-evaluated so far has seen the bank make an offer of some sort within a couple of weeks.

    Don't give up guys and don't be put off by the rejection letter. Scare tactics is all it is.

    i must say i am a little, - alright i am really annoyed at the way some people are able to claim there money back within only a few weeks and others of us have to wait the set time limits!! ahhhh!!!!!
    Anyway my story so far is
    End of March: requested Statments from Halifax
    May 1st:recieved statements
    May 3rd sent of give me my money back letter for £2332.00
    May 8th recieved we got you letter and will look into it, we will reply in 4 weeks but it may take 8
    May 28th: sorry we are still looking into it letter, wait another 4 weeks
    June 11th: sent letter saying you have charged me more stupid fines add it on to the money you owe, and unless you get it sorted by 27th June i am also going to add interest!!!
    June 23rd: Hell no we are not paying you we are correct!!!:mad:

    So now im not sure wether to just go straight to MCOL or ring up this Graham you are all on about and just ask for a re-evaluation, coz i thought the people whose names are at the bottom of our "NO go away" letters are the people we are meant to talk to - does it really matter?

    Any advise would be greatly appreciated

    Well I got my letter yesterday morning saying as a good will gesture they will give me half of the bank charges (no interest). I am not accepting this amount so I am calling them tommorrow, I couldnt ring yesterday as I think they were closed, it just kept ringing out. Have you had your money yet, they will probably wait exactly the 14 days wont they till they put it into your account?

    My money has been deposited today, Sunday. It wasn't there this morning! I actually got my goodwill offer on the 15th June and then I re-negotiated on the 18th June. So it has taken less than 14 days! Good luck. Make sure when you ring, you ring the number on the offer letter and be as nice as pie!

    Hi there im taking my bank to court cause i did not accept the amount of £521.50 as a gesture of goodwill yet the bank owes me £1673.17, my partner said to me why dont I take it at least I have something but really deep down I want to go for it as I really dont think that they should take my money. I have recently opened an account with the royal bank of scotland and they have been great I even had a phone call from them that the account was overdrawn not like halifax when they would just let the account go overdrawn and then I would have to pay a charge for it.

    Phone number at top of your decline letter.
    Say that you arent happy with decision and you want it re-evaluated,Also politely remind them that they have 8 weeks from your original letter and not 8 weeks from when you ask to be re-evaluated.
    Thats what i said and 4 days later i had an offer

  • Finally got my payment this weekend, first started in March this year, was claiming for 1450.00 and got 1154.00 first offer back. So keep at it, it does work you will get your money back.:j
