  • Well... I Have Read Through EVERY Post & Reply On This Forum, As I Bank With BOS & Thought This Would Help!IT DID!!!!!!!!!!!! I Called The Number & The Top Of The Letter, Pressed Option 2 and Waited For The Pleasant Staff To Answer, Which Was Surprisingly Quickly! I asked For My Claim To Be Re-evaluated, No Bother He Says, I'll Do That For You Right Now! You Will Have A Percentage Offer By The 26th July Which Will Be 50-60% of charges. He Informed Me That This Is NOT A Percentage Of What I Asked For, But What An Investigator Will Find... They Apparently Go Through ALL Charges Themselves On The Account & Come To An Amount!I Asked If I Wasn't Happy, Could I Appeal Against Their Decision And The Reply Was - OF COURSE, Just Call Back & Negotiate With Them! So, As I Was Able To Stay Calm & Patient (Which You All Advised To Do) Seemed To Get Me Further Than Freaking Out As They Will Not Help Me Out My Debt, I Will Continue With This Attitude Until They Resolve My Claim.GOOD LUCK EVERYONE! Hi, i was just wondering the same thing, however i phoned the 0845 No. at the top of my letter (im with BOS) after waiting 2 weeks and asked them if there was any progress on my re-evaluation as its been 8 weeks since if first initially claimed and they said they will get an offer to me by the end of the week. Beats waiting another 8 weeks.

    Hi there

I am trying to claim back £1660 from the Halifax Bank of Scotland. Eventually received all the charges statements, after sending 2 letter to them and having to make a couple of phonecalls. I have received the standard "sorry you have complained, but according to the terms and conditions all the charges should have been charged etc" standard letter  and have now sent off my second letter to say that I want all the money back or else court proceedings will take place, but...... if they do not respond and I have to start court proceedings, as I live in Glasgow it will be the Sheriff Court, but am not sure about which forms are to be completed. The small claims maximum is for £750, then there is another set of proceedings called Summary Cause forms but again the maximum for that is £1500!! Can anyone in Scotland who has gone to court please help?

Touch wood I won't be needing to go to court as they will pay out..........but knowing what they are like!

If you aren't following the advice given in this thread by phoning the bank t have your case re-evaluated and have decided to take court action you need to read the Reclaiming in Scotland thread here...

    http://forums.moneysavingexpert.com/showthread.html?t=308885&page=17

However, if you claim is more than £1500 you would be better to go through the Financial Omubudsman as recommend in the above thread.

    Hi Jo

I am in Fife and am claiming back £1400 from Halifax through Kirkcaldy court, what I had to do was split the claims down so that the charges and interest dont exceed the £750, it will take longer but you will get it all back in the end. It cost £39 to file it in the small claims court. If you are doing it this way start with the oldest charges first.

To file it through the small claims court you need to fill out an N1 form. You can either google it or go to CAG forums and register there, they have a template and also a section on claiming in Scotland. Or I have it saved as a pdf if you pm me your email address I can email you it.

Alternatively if you know someone who lives in England and you can use their address you can filke it through MCOL.

    Hope this helps

    Halifax...
Hi all, im am confused at what to do, I put the claim to the courts and the fourteen days were up yesterday, Halifax hadnt acknowledged it, so today I was just about to press the judgement button when a letter arrived from Halifax offering me well below half, there was no mention of court, I tried to ring number at top of page 01244695179 kept getting no answer, then finaly a recorded message came through which was very distorted and all i got was number not in use and 0845 with nothing else, now I have already won by default, do I ring that 0197 number, contact halifax in any way or press the judgement button, pls help, Thanks, cheers ..............
