To hm71, thanks for the advice. I rang, in my case an 01244 number and tried to speak to an Andre Miller who had written the letter. On both occassions I was told I could not speak to him and that the person I was speaking to could. All they did was note I was rejecting their offer and make a note on theiur system asking for the offer to be re-evaluated but could not comment on the timescale. When I spoke to the Halifax on the 0845 number they referred me back to the 01244 number. Talk about going round in circles.
Advice appreciated should I now start court proceedings or place it in the hands of the FOS. I would rather speak to someone and negotiate a settlement figure0 -
Hi guys, just looking a bit of advice.
We posted a SAR for my husbands old account with H'fax in April. we received a letter saying they are ont he case and they woudl be in cotact within 2 weeks. Obviously that has passed so we sent a letter giving the 7 days to reply or else. we had only just posted the letter when a couple of days later we got another letter from them saying that they had 'investigated' our 'complaint' and would refund our charges we aere asking for!
Now - we havent even got to that stage yet, we ahvent even got our statements??
Then to top it all off we got the same letter -twice- one today and one yesterday saying they got our reminder letter and that they were snowed nuder and that we would just have to wait!
Are they dumb or what?? what is our best course of action because apparently we have already sent our first letter requesting charges??

Thats bl**dy annoying! I must have been lucky then. although I had an 01977 number and they then sent an e-mail to my chap Dave who rang me back, i'm happy to give you that number if you want and maybe they will do the same for you?? I have read previous threads on here saying about 'without prejudice' in relation to taking the amount offered and then pursuing them through the courts/fo for the balance. Can't recall the full details but I'm sure a search will show up. Before I had my offer I was looking at the fo as its free and also if unsuccessful you can go to court,(doesn't seem as much paperwork for the fo either) if you go to court first I think i'm right in saying you cannot then go to the fo (not 100% on that but I'm sure someone on here will correct me if not). Hi Everyone!This is the first time I have used the foram so if I have done this wrong, apologies!My story is that I wrote to the Bank of Scotland 3 months ago (6th April)asking for my bank charges for the last 6 years. I received a letter on 15th May saying due to the increase of complaints there would be a delay in my request and I should receive this information within 2 weeks. I am still waiting!I contacted the bank yet again and they transferred me to a line with a message stating approx. "due to the increase of complaints their will be a delay with your request and you should receive this within 2 weeks" I feel that I am going round in circles and that the bank are using delaying tactics with me.I have now complained to the Financial Ombusman and they have wrote to the bank. Hopefully things will get moving.The main reason that I personally persuing to reclaim these charges is that for the last 2 years I was receiving treatment for Breast Cancer and was too ill to work so I was receiving no income. At this time bank was aware of my situation and they still charged my account quite heavily and actually had me in tears when they phoned about my account, they were not sympathetic to my situation at all.I anyone can give me any advice I would be extremely grateful.Thank you for your time.RegardsLorna Anne0

I am soon going to make the call to request the remaining balance of what they owe me, ie the other half without the interest.
Has anyone any hints or phrases i should use to sway them in their decision?
Not sure what the correct way of going about this is.
I assume i don't just call them and say i'm not happy with the offer and want the full amount!0 -
to be honest barryhefron thats exactly what I said! I called them on tues and said" on the bottom of the letter it says to call if I'm not happy with the offer, so thats what I'm doing" the chap said ok why aren't you happy I said " well I know if I go to court not only will I get the full amount but I'll also get the interest" fair enough he said, what would you be happy with "£2600" I said claim amount £2630, I'm only authorised to give £2500. oh I said thats a problem, I s'pose I could take that and then go to court for the other £130 +interest & court fees. hang on he said, put me on hold for 5 mins came back and said my supervisor says thats fine £2600 it is we will send out an acceptance form to you. great I said. half money went in yesterday on return of the form the rest goes in.

After speaking to who I think was Graham on Monday, I received an offer in the post yesterday (Wednesday), it was for £1,329.00 and I'm claiming for £2,619.00, so basically half. I rang the number on top of the letter which was a different 01977 number and spoke to a lovely guy called Neil who looked at it and said what would I accept to settle and I said, whilst laughing cheekily, £2,600??! He said it would have to back to be re-evaluated again and had no timescale. I asked if we could possibly settle it on the phone to save the waiting and he put me on hold. He came back and said that his manager would like to offer me £2,600.00 if that's ok (???!!), I said yes that would be fine and it will be in my account within 14 days. So keep your fingers crossed for me.
