I have just received a letter back from Yorkshire Bank stating that they have received my request for details of all my charges. In the letter it states that they are under no statutory obligation to record or provide any information relating to "manual intervention." Can anyone explain what this actually means? Thanks

    This is a BS letter.

"Manual intervention" means records of any actions logged or noted against your account for any of the charges made against you. In other words was the charge made by an automatic computer function, or was it as a result of a human saying "oh he or she has gone overdrawn I think I'll charge him or her". As for them not being under any statutory obligation to furnish you with that info, then someone is either lying or speaking through their posterior orifice. Any details held on computer about you are subject to the DPA and as such you can ask to see what information is held on you.
Hamsters have no tact and diplomacy, nor do they want any.

I went over to the court on friday and they said all YB cases have been moved to the chancery section where the judge looks at all cases regarding the bank charges and then it goes straight to a hearing (if it gets that far) all AQ's are dispensed with

Louise, I am almost at the same stage as you. I've just received my defence for YB and after reading this I can only assume that I will also be moved over to Leeds court also. Is the AQ a difficult document and what does it mean for it to be "dispensed" with??
    any help would be appreciated.
    Thanks

    HI,

After making a mistake (monumental) and sending my actual statements back to the bank with my first letter!!!! I have had the usual fobbing off letter, then I sent next letter threatening court action after 14 days, (I reworded the letter explaining I had returned statements but would re request b4 court date) I have had no reply from the bank and their 14 days are up, can I go to the next step and start an online court claim while I wait for new statements??? or do I start from scratch once statements arrive? please help
    many thanks

    Hi,

I have gone through stage 1 letter for statements, then sent letter 2 requesting refund, then after refusal letter sent letter 3 threatening court action after 14 days, this was up yesterday but today received letter from claim dept asking for more detail on charges etc, (I presume they want copy of spreadsheet (which due to major boob on my part, sent original statements instead of spreadsheet, although now have statements back and have done a spreadsheet) what letter do I send with the spreadsheet and how long do I give them to reply or do I just go ahead with starting court claim, so many questions, sorry

    thanks

Send them a copy of the spreadsheet. If you give them 7-10 days to reply from the date of your letter I think you will be more than reasonable. Good luck :)
  • Help please!
I've had all my statements back and after sending the first letter I have had a reply from the Yorkshire Bank stating that their charges were within their T & Cs. I've since sent off the second letter giving them 14 days to reply, however its now nearly 4 weeks and I've not heard anything  . I've spoken to my branch who state that the head office will 'probably' be dealing with it. How long should I leave it before going further? The prospect of court action is a little daunting - but then I am looking at £6k to claim so that makes it a little easier:eek: !

Any help would be greatly appreciated.
    Regards
