    Hi all,

I've been working on claiming charges back for my Mum's accounts with Yorkshire bank and done all the usual stuff i.e. get the statements, send off the claim, get the rejection letter and we sent the letter threatening court about 4/5 weeks ago...

As you can probably tell we have been a little, not lazy, but forgetful in sorting the bank claim out as we both need to sit down and do it but we have come home today and found that they've sent a letter (2/3 weeks later than we requested a response by) with a cheque for a quarter of the initial claim as goodwill, etc.

I'm a little confused now... should I write a letter asking for the rest and threaten court again or go down the court route as we have already threatened it? Do you think we might get it sorted sooner if we avoid court for now?

One thing we though (on a less serious note) is should we wait and see if the full amount comes through in a few week? lol It's like we don't even have to send them the letters and court summons for them to try and settle! Madness :)

    Thanks in advance

I would tell them that you will accept this as part payment without prejudice and will go for the remainder through court. And then file the claim, it is long overdue.

I am at the point where I am waiting for Yorkshire to make a defense against my court action. I'm set in my way that I will take them to the bitter end and NOTHING will put me off taking them all the way to court. Just one question though, has anyone been to court and actually lost? I read the section where it says someone lost once, but after that nothing. So does anyone know of any other cases that lost? And if you do lose, do you have to pay any costs for the Bank?

    Thanks

Hi, as I informed the solicitors for A+L today, I am only aware of 2 cases that have failed at court this year but considering MCOL are processing an estimated 1,500 bank charge claims a week I think the odds are in your favour!

Also a little light reading for you here from the BBC News website :)

Can anyone help? I recently asked for my past 6 years statements from Yorkshire Bank and paid the £10 (as per the guide). I then sent the second letter asking for my money back. Today Yorkshire Bank have rung me and said I need to pay them another £10 for them to look into my claim?? Is this normal?? Or are they taking the proverbial?

  • Could anybody please let me know the address of the Yorkshire bank where I send my initial letter for claiming my bank charges, the address I found for the head office in Leeds where I sent my £10 has failed to reply to me.
    Thank you for your time

No, you send them one £10 which is the statutory fee for the charges details. You shouldn't have to pay them anything but this :)

What did they say the additional £10 was for ?

This may be covered before but are the Daily unauthorised Overdraft fees covered when claiming back charges. These are between £8 and £5 each so by themselves seem to fall below the "suggested" £12 max charge however there can be a lot of them.
    Anyone any advice?

    Yes, they are :)
  • I've been trying to claim my bank charges back from YB and they have been really slow the whole time.
I've followed the procedure of Martins and am now at the point of going to court. The bank have now written and declared that they are contesting the request for my money back and I'm now wondering what to do next.
They have 28 days to sort their defence and I'm thinking that I will end up in court.
Has anyone else got this far down the line with the Yorkshire Bank and whats been your outcomes so far.
    Any help would be welcomed:confused:
