how does this sound?

Dear Sir/Madam,<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" />

Jacqueline Worrall V Clydesdale Bank PLC t/a Yorkshire Bank
Claim Number: ********

I refer to the letter dated 28th June 2007 and thank you for the copy of the defence filed by the bank.

The claims of the defence are a little confusing given that: -

A. The fact I have already detailed the charges – on the 29/03/2007 the letter sent with the charges and account details in and that I am concerned that you are dealing with this case without having kept the paperwork.

But

B. To confirm them I enclose them here.

Account Number ********

Bank Charges Interest Calculations

Details of all charges

I have sent a copy of this letter to the court to detail I am complying with all reasonable requests.

I trust this is all in order.

Yours Sincerely.

• Hi Louise Taylor
Success!!? Sort of. The is the first time I've heard of YB paying out anything! Can you tell me how long it has taken you? I've been trying since January and feel like banging my head against a brick wall. Just tried chasing them up on the phone only to be put through to the automated service. Very annoyed I rang again and demanded that I talk to someone, she relctantly put me through. I was advised that I should've had a reply by now and that they will ring me within half an hour ....... still waiting!!
Well done.

Update - got a phonecall back from the head office in Leeds saying they would send out the second reply by the end of last week. Received a letter from them yesterday saying that their charges were correct, but in the interests of customer relations have offered me £400, but stated that this didn't mean they were accepting liability (I'm claiming nearly £6k!). Told them I'm not interested and am now proceeding through the courts.
Just a tip - when you speak to the receptionist she will put you through to an automated service. Call again and demand to speak to someone - I did this and they put me through straight away.
Fingers crossed Yorkshire Bank do not dispute- but I'm not holding out much luck for that!!
Just heard on the news this morning that a judge has demanded that Yokshire Bank account for the cost of their charges or pay up. Perhaps that might be good news for us all?
• Hi, hope someone can help me with this. I have a claim ongoing from Yorkshire Bank, and as an act of defiance I have stopped my personal loan with them. Unfortunately I have now received a county court summons for the oustanding loan amount and wonder if I could make a "counter claim" citing the oustanding claim for bank charges? I have spoken to Yorkshire Bank and they tell me they are 2 different cases, and I cannot do that. Although they would say that,,, both are Yorkshire Bank. Can anybody give me any advice please?

Obviously I don't want to end up in Court, so any advice would be greatly received. Thanks xx:cool:
• Accepted offer and signed a letter excepting it, posted it back., but not received any money, rung Yorkshire bank solicitors (Jeremy Sutcliffe & Co, Leeds.) they can`t trace any letter regarding this even quoting there Ref.
On there letter it said if I did not reply in 10 days then the offer would lapse. I replied in 2 days.
So now nearly 4 weeks gone by, still no money so I feel like going for the full amount taking them to court.
Does the 10 days acceptance work BOTH ways & because I signed a letter of acceptance would this go against me.
Help please Mr. Lewis or anyone,
Thanks in anticipation, streetburner.

Id be straight on to the FO my friend! Alternatively give the bank a ring & see what they say, if they deny all knowledge of it then I would contact the FO.

Not a wise move really. Have you stopped paying it altogether? Your agreement on the loan is different to that of your account so they are right in saying it is 2 dif matters. However if I was you I would start paying it back, alternatively you could say your having financial problems & you can only afford x amount a month. If you took out the payment protection say you need that ;)

• Yes, thanks for that, I guess you are right, will try and come to some arrangement with them, but I guess so long as both parties agreed, the Court can only enforce what has been mutually agreed.
• I received the same letter and dismissed the sum they were offering me, and told them I would settle for a higher sum. I spoke to Jeremy Sutcliffe Co yesterday, and they gave me the telephone numbers for the Advice Quality Unit @ Yorkshire Bank, which was very helpful.. They told me I would receive another letter within the next 7 days. If you need the telephone number, I can post it on for you...
