  • So YB's 14 days to respond to my claim for a little over £4500 is up as of tomorrow.

    if im reading all the posts on various forums correctly i now have a couple of options :

    1) Send them another letter offering to accept a slightly lower amount (say £4000) and giving them 7 days to reply

    or

    2) Start filling in the court papers seeing as they've messed me around for this long as it is.

    Am i correct ??

    i've just registered with MCOL (in preperation) but am a bit confused when i get to filling in the particulars of the claim. I want to do this properly and not be the "cause" of any more delays (im sure YB will do that for me).

    Any suggestions for what i put down for this ?? I was just going to state that my YB current a/c has had numerous unlawful charges applied to it over the past 6 years and i want them paying back.

    Is that enough or should i elaborate more ??

    Also when you click "claim with interest" it advises you to include this text :

    The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}.

    The dates i don't have a problem with but whats the DAILY RATE OF INTEREST ??

    checking the status on MCOL ive just seen Yorkshire bank have placed a defence in so its no longer under the realm of this form of reclamation. looks like im off to court...no date yet tho.
    does anyone think yorkshire bank ever gives up...especially in light of the court procedings from leeds court over the last couple of days..they are clinging on like they are hanging off a cliff.. ah well next step reached!

    Daily rate of interest is the total amount of your charges (excluding interest) x by 0.00022

    Can i claim debit interest?
    I didn't, but did claim the charges at the end of ech month for £25 if you went over you overdraft and was charged the daily rate.
    I am waiting for a court date now, so be prepared for a long wait, mine has been going since January.
  • I am taking Yorkshire bank to court, for less than 3k. The have put in a defence and I have submitted my papers. They needed to be done by the 28th June. What happens now? It is the 29th now, do I hear from them or do I need to call the court to find out what haapens next
  • hi folks. I wrote a post here a while ago about the delay tactics that YB were using in my OH's claim for his bank charges. I decided to complain to the Financial Ombudsman and have now had a letter from them saying that they have taken up the case and are contacting YB.
    Watch this space ,I'll let you know how it goes

    Sent letter requesting charges plus interest on 18th June ,got reply 26th June saying they need to investigate the points I raised and will contact me when their investigation is complete. Should I wait or send the Lba Thanks in advance
