I have sent Yorkshire Bank my letter asking for details of all charges and I have firstly received a letter back telling me that they are not obliged to provide me with info relating to "Manual Intervention", whatever that means I am still unclear of but I believe that whatever they have on file about me they have to include in their summary of charges.
Secondly, I have now received a letter telling me that they cannot meet the 40 day deadline because of high demand. But I think they may have covered their backs with the following quote...."Whilst you are within your rights to refer the matter to the Inforation Commissioner, I confirm that we shall provide you with the information as soon as we possibly can."
Can I do anything about these two matters?

I cannot comment on the first one.
The second one is routine these days. You could report the matter to the Information Commissioner, but his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s.
The banks must have received so many "black marks" for missing the 40 day deadline that one more doesn't make any difference.
Of course, a cynic could suggest that the banks aren't that concerned about delaying potential claims. Why haven't they simply employed more temporary agency staff to ensure that they can deal with the increased number of requests and still meet their legal committment?
You cannot make a claim without knowing exactly what you are claiming for, but you can always plan your claim and prepare a draft template letter in the meantime.The acquisition of wealth is no longer the driving force in my life.0 -
I have sent off my initial letter requesting charge details to Yorkshire Bank. My first reply was a letter stating that they are within theit rights to withhold info relating to manual intervention. Firstly, I am led to believe that this actually is not the case and this information should be disclosed. Secondly, what on earth is manual intervention. I believe it is something to do with human enforced charges rather than computer generated.
Then I receive a letter telling me that they are unable to send my details within the allocated 40 days due to high demand and quote this...Whilst you are within your rights to refer this matter to the Information Commissioner at the end of the 40 day period, I confirm that we shall provide you with the informayion as soon as we possibly can.

We are in the same process with yb, these seem to be their stalling tactics, carry on as the money saving site suggests and make them stick to your timetable not theirs. We are in the process of taking them to court, they have filed a defence and the case has now been referred to our local court so i'm looking for anyone who has experience of this stage and beyond, i have spoken to my local court and they have told me that the allocation questionnaire is not required in this case and they will contact me regarding the next step. Any advice grayefully received.

I sent £10 to ask for my statements back,got them late but no problem, sent my letter asking for charges back and received call from a clerk to say they needed further £10 to forward my claim to head office(Clydesdale Bank, Glasgow) i tried to argue this but was poopoed,so sent another £10. No reply whatsoever to my claim so sent my 3rd template letter which was returned to me with a "compliments" slip asking for ANOTHER £10 to forward to head office. I contacted the F.O.S. and explained and they verified that YB were incorrect and they would contact them. Have received letter from head office today to state their T&C (yawn) and costs involved in admin and blah blah (£35) when all my charges are signed MANAGER YORKSHIRE BANK, LOUGHBOROUGH BRANCH, which has been closed down since Xmas 2005!
Not sure how to proceed, have i got FOS involved for £10 or the full amount i am claiming. Clint0 -
i have recieved my court date for the 28th june at the mercentile court leeds, it says i have to attend a case management confrence. attached to the letter is a case management information sheet that i have to fill in, is anyone to this stage yet, could have done with some help on some of the questions on the sheet. thanks0

Spoke to the court today & they told me their 28days is up at midnight tonight so if i still haven't replied by then, then i can take the next step via MCOL.
Will be watching the clock for 12.01am then hitting the the 'start' button

Hello again just sent two letters of one to the bank to tell them ive sent one to the Financial Ombudsman to reclaim my bank charges of £1,294. thats with interest i will have to sit back now and wait the outcome will let everyone know if im successful or not0

Hi there, I have just read all 16 pages of this forum and decided that I'm taking no more c==p from YB! It seems that they think they can hold out as long as they can and folk will give up or that they can still be taken to court but they are above t he law when it comes to paying out.
We have been trying to claim back OH's charges since January and they just seem to be lying and waffling to stall us.
They initially refused to refund, the letter said that if they had no response from us within 8 weeks they would close the case. We responded in 10 days. a month later the said that they had reopened the complaint and would be in touch as soon as possible (that must mean 12th of never in bank speak!).
We waited 3 weeks and then wrote and asked for an update of the 'investigation'. 2 weeks later (12th April) they wrote apologising for the fact that they had not given us an answer but expecting to be able to within the next four weeks. (10th May,if I'm not mistaken?) . Guess what....no answer!
I then wrote again ( my OH doesn't trust anything thats not in writing or said face-2-face) stating our dissatisfaction in their unprofessional attitude and giving them until 11th June to reply or refund (£850 by the way).
Well folks...its the 13th of june and we have not had any response to the last letter!
I have decided to lodge a complaint with the Financial Ombudsman and have just printed off the complaints form, thanks for the link EdinburghLass. OH is reluctant to part with any money in case we lose the claim, despite me telling him that we won't because we have followed the advice on here and the other sites.
I'm wondering if anyone has written to the OFT about YB and their tactics. They are the ones doing the investigations into bank charges so maybe they should be made aware of some of the stunts that these people are pulling?
I think I'll drop them a line and see what happens,can't do any harm can it?

ok so the day after i posted on here ^^^ i received my statements (last thursday) i have added up the charges with interest using the calculator and it amounts to just over £4500.
this afternoon i sent them a hardcopy of the charges i am claiming back and the 2nd letter. i have given them 14 days to respond to this which takes it to 26th June 2007.
i have sent this to the branch where my account is held, was this a mistake ??
if it was and i don't hear anything back should i continue with the 3rd letter giving them one more chance to repay me before going for the court option ??
