You'll find the timings for MCOL in the Reclaim Help Thread which is linked in my signature and if you have a read of this thread regarding actually getting paid...

Just had my response back from small claims court by YB in defense of my claim. Yet again a real jobsworth on a power trip effort trying to baffle me with banking jargon and the typical nonsense you'd expect from these cretins. Just wonderd where do I go from here ? Anbody got any advice or links where to go next would be very much appreciated:j

Saw a yb claim that was listed for hearing today. yb deposited the full amount into the claimants yesterday last thing.

There were also cases with LLoyds TSB and Barclays both settled the day before the hearing. Looks like the banks are now pushing these claims right to the wire.

Can't say the judge was overly impressed though, he had to go home early:rolleyes: He did mutter something about sanctions for wasted court time though.
  • Hi we are claiming £3200 from the yorkshire and are upto the stage of threatening to take it to court. We sent the LBA letter 3 weeks ago and have just got a letter from YBs solicitors with a cheque for £200 as "full and final settlement". Has any one had anything like this before and what do we do next. We are not going to accept this cheque for settlement.

    Send it whence it came.
Hamsters have no tact and diplomacy, nor do they want any.

I have also received a £100 goodwill offer this week from Y B solicitors and given 10 days to reply. I have written back (and posted through recorded delivery) and asked for the full amount £550 or I will reclaim through MCOL -with interest. Looks like they are now beginning to comply!!!!!
Started this back in February hopefully all resolved by June!

    Thats your answer!
  • I wrote off my first letter to the yorkshire bank and received a reply just before the forty days were up. The letter acknowledged my request and said due to the high demand for this service they were unable to supply this information within the allotted time and if I wanted to report them to the commissioner to go ahead and do so. This to me showed a lack of good customer service but then why should that surprise me with the way the bank had dealt with us over the last couple of years. It is now 3 weeks since we got the letter and still no statements. Any advice on what to do next?

Whilst I have every sympathy for the poor staff trying to deal with Subject Access Requests, if you haven't received all the information you require within 40 days of them receiving your request, report the matter to the Information Commissioner. However, his staff must be as inundated with complaints as the banks’ and credit card companies’ are with SAR’s and there’s only one of him.
