Reclaim Unfair Bank Charges article discussion Part II

Only been with this bank for the last few months after winning a payout from Natwest then changing banks.
Had no problem with them but just checked online and they took £150.00 from me yesterday in charges which means about 4 direct debits haven't been paid. There was £240.00 in on Sunday night and now only £90.00 which still leaves me with not enough to pay the direct debits with my debit card over the phone and there is a cheque due to go out any day which probably won't get paid either now. My husbands wages go in on Friday and by the looks of things won't be able to do any food shopping and with 2 teenage sons and a girl of 9 who never stops eating either it is going to be hell.
I have written the 1st letter requesting back payment of these charges whilst shedding a few tears and drinking a strong cup of sweet tea. (AND THATS WITHOUT TELLING MY HUSBAND YET WHO WILL GO MAD)
I really can't afford for this amount of money to be taken from my account within the space of a week. I haven't even been given any notification of these charges either, I thought there was enough money in the account to cover everything.
Is there anything I can do? PLEASE HELP0 -

You dont need to ask the solicitors anything, they arent likely to be helpful to you anyway since they are working for the opposition.
However they may contact you very soon with some ridiculous demands that look ever so official and are designed to panic you into backing down so have a read of this thread to be prepared for their shenanigans:

Dont cry, it isnt as bad as it seems and the banks are nasty and horrible for what they did to you*hug & sympathy*
Firstly i would ring the bank ( before hubby gets home) and see if there is any way they will refund the charges. Explain your mistake. Its a long shot but may just work in the short term. Even if they dont refund all charges they may refund a portion of them if you explain the difficulty they have left you in.
I might get jumped on here for posting this but hey, we've all been there and this is what I would do to minimise the damage immediately. I would ring up whoever the direct debits are due to go out to, explain what has happened and that they wont be paid this month on time and that you cant absorb the loss. I'd offer to double up the payment next month (assuming they are for bills paid regularly on a monthly basis. The direct debits can always be cancelled then, paid by cheque next month and then reinstate the direct debits once you're straight again.
This will give you the money you need immediately to get the weeks shopping in. Explain to the kids that money is tight while you try and make up the shortfall caused by the charges and they are going to have to work with you as a family to cope with the loss and eat less !
Hubby is going to have to lump it I'm afraid. Unless he wants the total responsibility of managing the household finances then he will have to accept this isnt your fault and you are doing the best you can to deal with the situation. There's always the sofa to sleep on if he isnt happy
As for reclaiming the charges if they dont refund anything or only part of them... you know the drill so good luck0 -

Yes you can reclaim charges on a business account. The process is different in the names of the charges you can reclaim and the law that is relevant to it. The business thread on this site is here:

Yes.
Most will offer you a refund of the difference between £12 and what you were charged.
Capital one will put this money straight in your account. At this point you can refuse it, and ask for the full amount.
Capital One won't budge. But if you file with the court, Captal One usually pay up the full amount, without actually going to court.0 -
Halifax have til close of business today to defend my claim for reclaiming my bank charges via moneyclaim.gov.uk, do i ring the 01977 627422 number today and promt them to do something, or do i wait til tommorrow and then i have won ?

The last thing you should be doing is contacting them . After all, you don't want them to defend.
On MCOL, there is a link under judgement which says start. Press that, and u win by default, if accepted. Don't worry if its too soon, it wont let you do it.
MCOL have been allowing late defences, so wait for it to say judgement issued, before getting too excited,0 -

Hi - started claim with letter template from Martin 12 March 2007, follow-up letter, both answered with standard 'we are within our rights go away letter from Nationwide - issued court claim on-line 15th May 2007 - bank defended whole amount then sent letter on 6 Jun refunding charges and court costs - ignored interest amount.

Has taken since February got as far as waiting for a court date, Friday i sent a mail to Abbey asking for £4000 to settle early, they sent back saying they would give me £3000, i replied saying £3500 no less and today (sunday) they have e mailed accepting. Money paid in within 10 days and no mention of account closure.
