From personal experience and reading 100's of other cases on here (I have had numerous claims on the go) it appears that if the claim is relatively small - only a few hundred pounds for example, if you stick to our timetables and do everything right i.e. 1st letter give them 2 weeks, letter before action give them another 2 weeks, then file court claim, you will have a very good chance of getting 100%, plus statutory interest.
I know for a fact that MBNA and Natwest are paying out what they regard as small claims in full. Not right away mind, and not lying down. You'll have to push. But in my humble opinion if your claim is not life changing money then why not push all the way to get the lot back. I accept if your are broke and your claim is in the 1000's it's more scary and a bigger risk.
The wording you will see on your letter when they pay you out will be along the lines of... ''you have no case in our opinion, however, we enclose a cheque as we do not regard it as being financially viable to continue proceedings. Winner!

Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
Halifax 2: Ongoing....0 -
I am claiming for my daughter from Tesco Visa, she had late fee's of £10 which amounted to £120 from 2002 to 2003.
I put in a claim to Tesco and they have written back saying:
Having reveiwed your case the only late fees applied are for £12, which is in line with the OFT's findings, therefore no refunds will be forthcoming
not sure what to do as this late fee is under £12
Should I appeal and what should I say?

hi, am completely hopeless with computers so please bear with me, need some advice re claim against lloydstsb claim originally for 5,600, was advised to split into two seperate claims to keep on small claims track, sent for statements in feb 2007, received and sent letters by mid march, no response,started claim 5th April,paid £240 court fees for both claims, deemed served 21st April, lloyds to respond by 8th may. No reply to 1st claim was given judgement by default, but acknowledged 2nd claim. Paid out end of may but didnt pay court fee, still havent! Defended 2nd claim even though both claims went through on same date etc. Still waiting for court date, handed in AQ and paid £100 now waiting to go before judge for directions and court date, have contacted SCM lots of times re: court fees for first claim, no help! What next? why is it taking so long when both claims filed together, and all this time they are still charging me each month, any advice?0

Crystal...I too have been in the same situation....There are 2 things I can say to you....but I am a big talker...so I might say more than 2 words !! Firstly, you stick to getting your charges back...then your husband will be there with you..100%!!! Next...as for the gas bill....you phone them up and say that you are on benefits(even tho you might not be) and get them to either ...1) reinstate your card payments 2) get a meter card payment set up or...if you need... 3) get DHSS to intervene and help you out. By the way, if you call them, they might give you another card to pay with. As long as you keep in contact with ''them''...things will turn out ok!! Remember...there is always a silver lining behind every cloud!!!! At times like this it seems hard to believe....but it is true!! Crystal...I have to write again to you...you hang in there and keep in contact with us all......I can feel your pain....but honey I have been thro it all too...and can offer you 1st hand experience. I actually am a mother of 2 kids...separated and struggling on benefits !! I have juggled bills here and there....got food which is cheaper.....AND do without myself!!! It is difficult...esp when you feel alone....But things will ease off...only if you keep in contact with all here...and the companies you deal with. Hope I am being of help to you and not a pain in the !!!!!!!!0

I have no intention of delving into your persanal affairs but why did A & L take £150 ? Could you explain what happened to create this charge please.
This will help us on this forum to understand and then, hopefully, give you sound advice as to what to do next.
We are all on your side but to help, we need a little bit more info.
It might well be a good idea to ask your husband to get involved on this forum and he will quickly see that your problem is the problem of many.
There are many experienced people here and "Edinburghlass" is one of them.
I feel certain that your husband, after reading the numerous posts, will see that you are not alone and will join in the fight against these banks.
Rest assured that as each day passes, one of these banks will be forced to explain the charges. When that happens, all hell will be let loose, not for us but the banks who gorge themselves on unlawful moneyThe Winner Takes it All0 -

I have the same problem with LX direct.
They only charged £10 a time, so i was unsure if to proceed.
But the law states they should be proportional to cost, and the OFT's decision is not binding, only a level at which they would get involved.
So i have proceeded, and suggest you do the same.0 -

My MCOL STILL says acknowledged!!!
on another note....have received statements from Capital One now (and they cashed my chq) Have sent first letter asking for refund. Its not much, £174 + interest coming out at just over £240 so we'll see what they have to say. That a/c was sold to debt collectors but it was repayed as the firm offered me a deal after a while and I payed 50% of the total owing in full and final settlement, so Cap One can't put it into the a/c as the a/c doesn't exist.0
