  • I have today received duplicate copies of statements from Abbey, but only for the last year, not six years as requested. Does anyone know what why?

    As I said I received this today from the Halifax Plc, and another part of the letter states :-

    Halifax said " As explained in our previous letter, When you opened your account, you agreed to our terms and conditions which explained that charges would be applied if you did not keep to the terms of the account. Furthermore, we apply these charges because when customers have insufficeint funds in their account to cover a payment they have asked us to make, This means iadditional work for us. As a result, we feel it is reasonable to charge for this service".

    What do we do now we have sent the last letter before taking legal action as we told the Halifax that if we did not receive the full repayment plus interest we would use MCOL so what do we do ??

    They have made a gesture of goodwill of £ 1,326.00
    The Halifax took £ 4,619.00 in six years ??

    What do we do can any one help??

    IF YOU HAVE ALREADY DONT THE LBA , THEN TAKE THEM TO COURT FOR THE REST BUT WRITE BACK AND TELL THEM YOU ONLY ACCEPT THE MONEY GIVEN AS GOOD WILL AS PART PAYMENT WITHOUT PREJUDICE AND WILL CONTINUE TO MCOL FOR THE REMAINDER IF NOT PAID IN FULL IN 7 DAYS

    I am also in proccess of claiming from abbey. You will find they will send you the last 12-14 months statements as duplicates ( but beware there is no charges summary as on your usual stements you need to check through the transactions). Then they wiil send you a table with summary of charges for a couple of years and then copies of all transactions for the remainder of the six years. Mine took slightly longer than the 40 days but they did refund the £10.
    I am claiming £4959 plus interest and have just filed my claim with MCOL.
    Just sent for sons statements from Nat West.
    Hope to post success story one day in mean time big thank you to Martin and fellow moneysavers would never have claimed without help from this site.

  • Hi Bankbandit - any news on your claim yet?? I just read your post about feeling like the only one that would lose.........I think thousands of us r the same tho. I am fed up of playing the waiting game too, I called Member Services this morning but didn't get anywhere, the lady was v.polite but said, and i quote " we only pay out refunds from here if someone has died" try Eversheds (Solicitors acting for Nationwide) needless to say I was stunned for a moment - I asked s few more polite questions, i.e why, it seems do some cases go all the way and some are settled before court. In a nutshell she said that they are only settling if instructed by the FO or Court. Which leads me to my next question............1. do you have your court bundle?2.what do we need for the court bundle? anyone!! 3. does anyone have a telephone number for Eversheds Solicitors in Cardiff?All advice greatly appreciated.Cheers

    They may well have said in their terms that charges would apply but AT WHAT COST ? It's just yet another "fob off" from Halifax.

    Please understand that if Halifax really thought the charges were fair and could PROVE IT, they would never offer you what they call "a gesture of goodwill" Halifax along with every other bank well know they are on a hiding for nothing. But, they will keep "trying on" these silly offers. It's getting very boring.

    GO FOR THE £4,619.00 IN FULL. You ask Halifax how they calculate their charges and request a full breakdown, they will never tell you because they know the flood doors will open against them.

    On the basis that they will NOT give you a breakdown, tells you and everybody that THEY ARE WRONG.

    The sad thing is that these banks are treating people in a pecking order, if they think they can scare you, indimidate you, believe me they will try.
    IF YOU FRIGHTEN THEM and show just how serious you are and that you will ask the court for a full breakdown of charges ... you go to the top of the list for a quick refund IN FULL.

    You'll get your full £4,619.00, just let them know who you are and what you intend to do. All banks are scared stiff that they will be forced into a situation that will cost them ££££ BILLIONS

    HI. GLAD U SUCCEEDED WITH CLAIM. CAN U ADVISE ME ON TWO ISSUES PSE. FROM WHAT DATE DOES THE SIX YEARS START. BARCLAYS HAVE SENT ME STATEMENTS FROM 1 JAN 2000.THAT MAKES IT 7 YRS. ALSO, I SOMEHOW MANAGED TO 'NOT' GET ANY CHARGES IN 2003; IS 2003 STILL COUNTED AS ONE OF THE SIX YEARS? HOPE YOU CAN HELP. THANKS.:confused:

    My advise to you would be to call them using the number at the top of your letter. I received a letter this morning from the Bank of Scotland offering me a goodwill gesture of £2,432 (my claim was for £4,813 + £590.92 int). After a very polite conversation I negotiated the worthy sum of £4,000.....needlessly to say as I stay in Scotland I am very happy with this and look forward to seeing it my account. Give it a try and good luck.

    Has anyone been unsuccessful using MCOL if so how much were the court costs.
    I ask this because i'm not to sure,
    When i used to get paid (monthly) i spent my wage within the 1st week then direct debits would come out and i'd be charged, would the courts not think it was my fault.
