Just recieved a letter from Bury County Court informing me that the District judge had ordered that ` The claim be struck out as disclosing no reasonable grounds for bringing the claim`.
Has this happened to anyone else and if so what did you do next?
I was not contacted by the court for any infomation nor was i informed of the date of the hearing.
Any advice would be most welcome0 -
Have you been given a date to file papers with the court? If so read this thread and follow post 120 by Rex_Mundi.

question 1. do i need to send another cheque for the second account??
question 2. do i just write again and ask for the rest of the statements??
thanks in advance0 -

Its probable that they have only dealt with one account so far and that details pre-2004 are archived and will take longer. Its practice for Abbey, for one, to send out around 18 months worth as copy statements and the rest later from archives.
Just to cover yourself I would write and advise they have so far breached your entitlement to the data under the data protection act and reiterate that you require both accounts details and the full six years on each. Dont pay another fee its not neccessary

Hi caseyjade100
Nationwide said they were going to defend my claim for just over £3200 too. On day 28 my (almost)ex husband rang and said he'd got cheques from Nationwide payable to both of us for total claim incuding the court costs and interest so don't worry. Its unlikely they will take you all the way. Our history was not very good either and we were having to live on(or over!) overdraft each month-not helped by the extorsionate charges Nationwide lumped on us!!Hang on in there. They will try to scare you into withdrawing your claim but don't be tempted. Its YOUR money and they nicked it. Often its their fault we end up overdrawing the overdraft anyway!
Good luck
Hope this puts your mind at rest a bit.:D0 -
outonmyownnow wrote: »Hi Bankbandit - any news on your claim yet?? I just read your post about feeling like the only one that would lose.........I think thousands of us r the same tho. I am fed up of playing the waiting game too, I called Member Services this morning but didn't get anywhere, the lady was v.polite but said, and i quote " we only pay out refunds from here if someone has died" try Eversheds (Solicitors acting for Nationwide) needless to say I was stunned for a moment - I asked s few more polite questions, i.e why, it seems do some cases go all the way and some are settled before court. In a nutshell she said that they are only settling if instructed by the FO or Court. Which leads me to my next question............1. do you have your court bundle?2.what do we need for the court bundle? anyone!! 3. does anyone have a telephone number for Eversheds Solicitors in Cardiff? All advice greatly appreciated.Cheers
Hi outonmyownnow!!
What the lady at Nationwide told you is rubbish. I have been paid without going to court £3200 which included court costs and interest. What she was doing was trying to scare you off. Collect evidendence and prepare for court seriously, but it's unlikely you'll need to go that far. No way will the banks want to divulge their charging policies!! They will try to scare you off instead. Nationwide paid up on the 28th day for me, so hang in there and don't be put off.
Good luck-hope this helps a bit.0 -

Morning Bankbandit
Calm Down! Mine STILL says acknowleded and I've been paid and notifield the court!!
If they've paid your court fees then I'm sure they intend to pay the rest. Be patient and check your a/c now and then during the day. It'll go in in dribs and drabs I expect (if there's a complicated way to do something Nationwide will find it!!)
PS-Well what did I tell you! Congratulations, you truly are a Bank Bandit :-)0 -

Previously claimed and won for my own account, and now doing it for a friend with two accounts. Natwest and Lloyds
Lloyds are being a pain, wrote requesting the necessary stmts, 40 days passed without receiving the stmts so rang... was told they had a backlog of 6-8 weeks so had to wait longer, still not heard from them (has been over two weeks since the 40days ended). What can I do?
Natwest: Got the necessary stmts, worked out the charges were over £2300 (with interest). Sent off the letter asking for the money with the 14 days deadline and got a reply today saying:
"We are currently considering your claim. given the work involved in assessing your claim we anticipate that we will be be in a position to respond in 6-7 weeks, but will endeavour to do so sooner if we are able to."
What do I do next? sit n twiddle my fingers?SLC: £13000+
Quidco: £131.24 (paid) + £0 (validated) = £131.24
Valued Opinions: £75 (paid) + £52.30 (received) + £4.50 (pending) = £131.80
StudentPanel: £250
