Previously claimed and won for my own account, and now doing it for a friend with two accounts. Natwest and Lloyds
Lloyds are being a pain, wrote requesting the necessary stmts, 40 days passed without receiving the stmts so rang... was told they had a backlog of 6-8 weeks so had to wait longer, still not heard from them (has been over two weeks since the 40days ended). What can I do?
Natwest: Got the necessary stmts, worked out the charges were over £2300 (with interest). Sent off the letter asking for the money with the 14 days deadline and got a reply today saying:
"We are currently considering your claim. given the work involved in assessing your claim we anticipate that we will be be in a position to respond in 6-7 weeks, but will endeavour to do so sooner if we are able to."
What do I do next? sit n twiddle my fingers?
Lloyds you can download the statements/info from internet banking so this would save you waiting anymore time.
NatWest are part of the RBS Group who are making offers at the 7/8 week stage however of course its up to you how you conduct your claim. Read the relevant thread for your banks which you'll find linked in the Reclaim Help Thread.0 -
wondered what you meant "oldandskint" about Hull.
Here it is.
http://news.bbc.co.uk/1/hi/business/6270998.stm
It's nice to see that Judge Iain Besford in Hull is asking the right question ...
"the banks would have to explain their charging structure."
Yorkshire Bank is the Headline here but of course this is applicable to all Banks. This means that the Banks in future are going to be very careful before they make their wild threats of a defence in Court. It is very likely that Judges around the country will follow Judge Iain Besford's lead and pick at random any one bank and ask the question above.
A VERY DANGEROUS POSITION FOR THE BANKS NOW
Dare the banks risk a test case ???? Unless they are financially suicidal and are prepared to declare such huge losses on the Stock Exchange, the answer is NO.
In boardrooms around the country, this will be todays topic. Never in the history of banking have they been faced with such a problem. Wonder what the numerous Chairman will instruct their underlings to do ?
As of now, any bank could be the target of a Judge. For us, it will make life simpler because it will reduce the number of empty threats they make and it will reduce the time they waste for the courts.
With this in mind, everyone much continue with the threat of court action if their claim is not met in full. It would be a "foolhardy" bank who ignores you.
Until a Judge actually drags a bank into court, and that will happen sooner or later, do not lose sight that YOU WANT YOUR MONEY BACK WITHIN THE STATED 14 DAYS ..... Court action follows without further notice.

They must work to your timescale, you do not work to their timescale.
You have given them 14 days and if they wish to ignore that is their problem.
After the 14 days, if they have not refunded your claim in full, go immediately to the summons stage. The Winner Takes it All0 -

with respect to the judge asking the bank's for a detaild list off there charges .what worries me a little is why the banks turned up in the first place ? surly they new this was going to happen unless they have found a way a loophole or something that they can turn up and win
why now after all this time surly if it goes against them it will cost them billions are theythat stupid ?:rolleyes: ITS A FAR BETER THING I DO NOW THAN I HAVE EVER DONE BEFORE

The Banks don't turn up and from I see, neither did Yorkshire Bank in this instance. Clearly some of the cases involved the Yorkshire Bank and the Judge decided on them.
There cannot be a loophole for them, we are talking about British Law here and it is that law we are using for claiming monies back. The Winner Takes it All0
