Reclaim Unfair Bank Charges article discussion Part II

i am in the process of taking nationwide to court. total charges is £5203, i am asking for £5000 back. recieved a letter today from nationwides solicitors saying that they are going to defend my claim and now i'm scared!! very nervous about going to court and worried that i will lose! my history with nationwide is not very good and i am always in my overdraught, will that go against me? hope someone can help0

Has anyone been unsuccessful using MCOL if so how much were the court costs.
I ask this because i'm not to sure,
When i used to get paid (monthly) i spent my wage within the 1st week then direct debits would come out and i'd be charged, would the courts not think it was my fault.

Well, to get charges for the way you handled your money is reasonable.
What is NOT reasonable is the amount they charge per transaction. This issue is nothing to do with mis-handling of money, it's a point in law that the banks apply unreasonable, unfair charges. How it happened IE in your case, is not relevant. If you want your charges back, you know what you must do.The Winner Takes it All0 -

caseyjade, look back through this forum and you'll see many such banks say they will defend. It's become a bad habit with them because in reality, even though they may put in a standard defence, when crunch comes to crunch, they do not appear in court. Nationwide like the rest will never be put in a position where they have to answer in court ...

HELLO ALL. HAVE CLAIMED AGAINST BARCLAYS AND EVEN BEFORE I WORKED OUT AMOUNT THEY OFFERED ME £1050 NOW. I WOULD LIKE TO KNOW ABOUT THE 6YR BIT. THEY SENT ME STATEMENTS FROM JAN 2000 WHICH MAKES IT 7YRS; WHERE DO I START THE 6YR PERIOD FROM? ALSO I DID NOT INCUR ANY CHARGES IN 2003; IS 2003 STILL CLASSED AS ONE OF THE 6YRS? LASTLY, WHEN I HAVE WORKED OUT THE MONIES OWED TO ME, SHOULD I TAKE OFF BETWEEN £2 TO £4 FROM EACH CHARGE FOR THE CORRECT RATE. IE. WORK MY CHARGES OUT AT £28 FOR A £30 CHARGE.

hI JUST CHECKED MY ONLINE ACCOUNT WITH NATIONWIDE AND 120 HAS BEEN CREDITED BY CASH. THAT COVERS MY COURT FEE.
SO WHAT NOW , WHEN WILL I GET MY CHARGES BACK AND INTEREST.
DOSE THIS MEAN IVE WON OR NOT
