I've had a reply from the Data Sharing Team at the DVLA:
We can confirm that Town & City Parking is the trading name of Smart Parking Ltd and that they are members of the BPA Approved Operator Scheme. DVLA do not solely rely on the BPA website to provide confirmation of approved operators as the website may not be completely up to date, this information is checked separately with the BPA themselves.
Now that you have established a dialogue you could follow it with a complaint about your data being passed to a private company. Add in the wording as suggested by broadsword on pepipoo, this is a good level of attack, make the DVLA have to answer lots of complaints:

Hi all,
I got a parking ticket from smart parking when I parked in Dundee, just outside Matalan I saw parking was free for two hours but did not realise I still had to get a ticket. hmm this was all before 10 on a Saturday. was away 20 mins and came back to a ticket. I wrote to Smart Parking. Just received letter back saying I still have to pay £40 AS pcn was correctly issued.
Its a steep fine for something so trivial, what do I do, any advice?0 -

You have posted about an incident in Scotland on a thread that I don't think is about Scotland because POPLA was discussed above (doesn't apply in Scotland!).

Today I've received a letter from Debt Recover Plus Ltd headed "Notice of Intended Litigation" and saying that Smart Parking are their client.
The original ticket as for £40, they now say that I owe £120 and if I don't pay they will advise their client to take me to court.
Can anyone advise me further - should I continue to ignore do you think? I'm a single mother on income support but I have good credit and don't want to jeopardise this, I've never been taken to court. Help!!0 -

I had read many of the posts regarding this subject already but hadn't seen the ones about letters threatening court action. Forums like this are invaluable! Thanks again.0 -
Can anyone advise me re a PCN I have received from Smart Parking Ltd. I was doing work as a volunteer and parked in B&M retail in Greenock (Scotland), where I have spent hundreds of pounds since they opened. I was in a hurry and did not see the notice about parking. I was unavoidably delayed and couldn't get back to collect my car until four hours later. I have been sent a demand for £90 reduced to £45 if I pay within 14 days. There is no Mention of Smart Parking on the notice at B&M car park, only Town and City parking with the Ltd scored out. Do I have to pay this? It seems excessive!0
