Hi,

I've just received through the post a Parking Charge Notice from Smart Parking Ltd (also trading as Town and City Parking) for breaching advertised terms and conditions within ASDA STORE. The photos show my car entering and leaving the site 2 hours 2 minutes and 2 seconds apart. The contravention in question is Over Free Time.

Having read through the forum most threads seem to be about where notices have been issued on the day where there are pay and display machines, but not those just done by CCTV and arriving 2 weeks later. Is the advice still the same? Reading elsewhere it seems to suggest that you pay now and then dispute the cost later.

It states:
If payment of £40.00 is not received within 14 days of the date of this notice the discount period expires leaving £70.00 to be paid. If the full settlement is not made within 28 days of the date of this notice an additional £10.00 administration charge will be levied. Failure to respond to this notice may lead to civil legal action being taken to recover the parking charge notice charge (together with any judicial expenses that may be incurred).

It does say that I can appeal against over staying the free permitted period by providing a copy of receipts for consideration.

You don't pay then appeal ever. What you do is not appeal or pay and just ignore them completely.

Thanks, I have noticed (as someone else in another thread has), that even though they say 14 days from notice, the deadline date they have put is only 10 days from the notice!

The idea of this is to panic you into coughing up without thinking too deeply. With some people this would work as they think they are saving money by paying early, wheras if they investigated more they could save all the money. Its a pity that more people don't realise this.
ps. I used to think this a long time ago but being a goody goody driver I have never had a ticket/invoice.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

I've just had a look at AOS members list on the BPA website and noticed only Town & City Parking Ltd are listed there but neither Town & City Parking or Smart Parking Ltd are despite them having the logo on their paperwork!
Should I email BPA to complain or is that like blowing into the wind?

It also has logos for Park Mark and Safe Contractor Approved.

    Well well well.
With all the trouble this bunch of scammers have caused themselves it appears they are still at it.

They recently changed their name on the AOS list to Smart Parking Ltd (formerly TCP).
Now they've changed it back again. On that basis, they would appear to have obtained your details under false pretences.
You could complain to the BPA but nothing will happen.
    Better option is.

It does say Town & City Parking Ltd on the aos list (again) so if you take it like that then a complaint to the dvla is in order, because neither of these are Town & City Parking Ltd, and if they used that to get RK details then Smart are writing to you then there are problems. Also what do the signs now say ?

This is a disaster for them, I am laughing at the comedy gold this is, it's calamitous for them ;)
