It does say Town & City Parking Ltd on the aos list (again) so if you take it like that then a complaint to the dvla is in order, because neither of these are Town & City Parking Ltd, and if they used that to get RK details then Smart are writing to you then there are problems. Also what do the signs now say ?

This is a disaster for them, I am laughing at the comedy gold this is, it's calamitous for them ;)
And i've potentially got several 'tickets' due. I do hope at least one finds it's way to me. Unfortunately it seems some of the ANPR sites don't go live until Monday so i may have to visit a few more sites. :D

It ties in somewhat with their reluctance to change the names on all their signs.

I'm more than ever convinced there is an imminent phoenix about to occcur.

I've just had a look at AOS members list on the BPA website and noticed only Town & City Parking Ltd are listed there but neither Town & City Parking or Smart Parking Ltd are despite them having the logo on their paperwork!
Should I email BPA to complain or is that like blowing into the wind?

It also has logos for Park Mark and Safe Contractor Approved.

What did Asda say when you complained to them? The Store Manager there should bear the brunt of your anger.

Complain in writing (or in person, but NOT by phone) to Asda about this harassment of their paying customers. I would make it known that you are angry about all the harassment you are now going to get. If CS girly says 'we don't own the car park, the Council do' (typical Asda knee-jerk and wrong answer) then tell CS girly it makes no difference and she's wrong anyway. Asda are the ones who contracted with TCP (but as far as we know, not with a company called Smart Parking...!). And speak to the overall Store Manager only (not a 'Duty Manager' from the meat counter or other Dept).

This Asda car park scam is discussed on loads of threads every week, such as here:

https://forums.moneysavingexpert.com/discussion/4461723

Basically, like all the other posters on this board, you have a fake PCN, a misleading invoice. Ignore it or appeal it all the way to POPLA - but do complain!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well well well.
With all the trouble this bunch of scammers have caused themselves it appears they are still at it.

They recently changed their name on the AOS list to Smart Parking Ltd (formerly TCP).
Now they've changed it back again. On that basis, they would appear to have obtained your details under false pretences.
You could complain to the BPA but nothing will happen.
Better option is.
foi@dvla.gov.uk

I have sent the following to the DVLA:

Dear Sir/Madam,

I have recently received a parking charge notice from a company called Smart Parking Limited which claims they have had confirmation from the DVLA that I am the registered keeper. Also on the letter they say they trade as Town and City Parking.

I have checked the BPA website for the list of Approved Operator Scheme Members, which I believe they need to be on to access the information from yourselves. The only company with a similar name on that list is called Town & City Parking Ltd (note this has "&" instead of "and" and includes "Ltd").

Please could you explain why Smart Parking Limited has been given access to registered keeper details?

Let's see what comes back.

I presume you are emailing them, provide a link to the aos list, and also attach a screenshot of it as well. Your last paragraph add this at the end

when they don't appear to be an approved operator. And are a separate legal identity to the company on the aos list

Just been and taken a picture of their sign. No mention of Smart Parking Ltd, just "Town & City Parking". Quoting from the sign, where [###] is a blacked-out word, probably Ltd:

"Town and City Parking [###] will request the keeper's details immediately for any vehicle overstaying the maximum stay period for the purpose of serving a Parking Charge Notice generated from ANPR evidence. If a Parking Charge Notice is issued by a parking attendant Town and City Parking [###] will request the registered keeper's details from the DVLA for the purpose of recovery of the notice if this is not paid within 14 days of the issue date."
"If the Parking Charge Notice is not paid within 28 days an additional £10 administration charge will be levied."
"This car park is private property and is managed by Town & City Parking [###] on behalf of ASDA STORES LTD."

How long does it take for the DVLA to reply typically?

Hmmm, looks like that email address is incorrect as I got a bounce message:

I've had a reply from the Data Sharing Team at the DVLA:
We can confirm that Town & City Parking is the trading name of Smart Parking Ltd and that they are members of the BPA Approved Operator Scheme. DVLA do not solely rely on the BPA website to provide confirmation of approved operators as the website may not be completely up to date, this information is checked separately with the BPA themselves.
