    As there has been more than 14 days notice given of the reschedule/cancellation, EU compensation does not apply. You should ask the agent what your options are

    Hi,
    My husband suffered just shy of a 48hr delay whilst coming back from LA on the 23rd July with Norwegian (I, through miscommunication when we booked, had a fantastic flight 2 hours earlier with Air New Zealand- really recommend them!) and had to endure what sounds like total ineptness from the airline.

    During the delay they spent nearly 4 hrs on the tarmac, to be told that the flight was cancelled, and then to be told there would be no hotels unless they sourced their own. Families with young children were left to sleep on the airport floor or outside. Luckily for DH he wangled his way into the military lounge and found an office chair to get a bit of rest.
    The flight was rescheduled, then suffered more delays before being cancelled again (combination of aircraft technical and insufficient crew rest as they couldnt get a hotel either).
    Long story short, they landed back into LHR on Saturday morning rather than Thursday afternoon.

    Point of this post; having read the stickys im pretty convinced that this should qualify under the EU regulation as Norwegian is a european company and the flight landed in the UK. Am i right in this thinking?

    The other point, DH doesnt think its worth claiming compensation as his work booked it. I disagree and believe it should be claimed on principle and regardless, he missed work (when he should have been on call) so there is a loss of earnings as well as a lack of duty of care on the airlines part?

    Can anyone offer any advice about whether its worth pursing and also whether anyone has had a successful claim against Norwegian?

  • Monarch will only accept a claim on their form, so I have had to resend everything even though I had sent it with the template letter!

    I wouldn't have wasted my time. It's not up to them to prescribe how you should communicate. Just another ruse to put people off and delay.

    Technically Norway is not in the EU, they voted against joining but my understanding is that EU 261 does apply, as it does for departures from Switzerland as well, otherwise you fall at the first hurdle. As regards paying out, it seems Norwegian is not the best, lawyers in Sweden began legal action against them 2 weeks ago because they have claimed 'technical faults' in every single case. They are of course entirely dependent on the wretched Dreamliners, I believe in the same week your husband was caught up, they had three 40 hour plus delays at Gatwick.

    On the face of it there is a claim but beware it will be like pulling teeth to get the 600 Euros due.

    I've spent ages reading loads of information. I'm posting as i can't find the one bit of 'assisitance' that i need. I can't find a working link to a Notice Before Action template.

    I would be extremely grateful if someone could help me find this. I am not being lazy, i just can't find the thing i need.

    There's no magic or complexity to a NBA - it just needs to give the facts of the complaint and make clear that if the matter is not satisfactorily resolved within a specified time frame (14 days is reasonable) you reserve the right to initiate court action.

    Hi


    We were on the same flight and have claimed against Norwegian Air who are blaming technical problems and claiming that they therefore are not obliged to pay any compensation.
    What is really annoying is that they have suffered several similar delays with the Dreamliners but appear not to have any contingency plans or backup in place to mitigate the delays and inconvenience caused.
    They have offered us $150 each as a goodwill gesture but I'm contemplating taking it further.
    There is a facebook page set up by other passengers called Norwegian flight DY7096 which has other information and video links etc.
