    The delay from the UK appears to have been 1 hour, 3 hours is the minimum needed for an EU261 claim and it is the second flight on a non EU airline departing Dubai which appears to create the long delay. Not sure even a no win no fee business would chance it but might be worth talking to one

    The law is unclear this point. It would be entirely possible to argue that the Folkerts judgement permits the claim. In fact I think it does.

    Regardless we should avoid giving the impression of definitive and authoritative advice, when the reality is more complex.

    Thank you for the response. My flight got cancelled and I haven't received a refund yet (After 2 months). Is there an SLA for refunds after flight cancellations?

    No idea but I think 2 months is absolutely ridiculous. There can be no excuse for that kind of delay in (presumably) simply processing a credit.

    It's funny that I only receive a response if I go to their social media pages.

    Called up customer services to be told that the complaint department doesn't have a contact number, only email!!

  • Just a bit of advice on my next step with Tap Portugal.
    I sent complaints about our cancelled and rearranged flights and also our delayed flight on the return. I did this online via the complaint form and I also sent recorded/Tracked letters to their head office address in Portugal.
    The recorded letters were received on the 9/9/14 and the online complaints state "Contact under analysis"

    I have had no response from them from any of my attempts at communication so I am not sure whether to give it more time or proceed to the next step.

    Any advice would be welcome.

    Well your next step is really court action but before doing so you need to issue your letter - notice before action - as most cases are being held up by Huzar I would give it another week or so (try 'reminding' them again then forward your NBA giving them 21 days to respond then court application if no positive reply.
  • Can anyone advise? Claimed compensation for 4.5 delay flight from Heathrow to AbuDhabi with Etihad. Got response within one month claiming exceptional circumstances because delay resulted from them having to remove an intoxicated passenger at their 'hub airport' i.e. Abu Dhabi - hence delaying the flight into London and in turn, our flight back out again. I think they are wrong that these circumstances mean that they are not obliged to give compensation but would appreciate any views and advice on where to take my claim now? Etihad say that they are not obliged to adhere to EC Council Regulation and have offered 10,000 guest air miles/points to each of our party (family of 4) as a goodwill gesture. I have checked and this is enough to buy one small carry-on suitcase.

    How did it take them 4.5 hours to remove a drunk from an airplane? and when did this happen? Sounds like a fishy excuse to me!
