    The regularity of bird strikes insofar as !!!!!! indicates that they can cause severe damage to, in particular, jet engine turbines.

    Did something happen recently to do with judging how a technical fault is considered?

    I claimed against Air Lingus flight in 2012/13 for a delay in boarding and the claim was dismisssed :

    "This particular flight, EI3842 was delayed on the grounds of an aircraft technical problem which was beyond Aer Lingus' control, in this instance, a condition levers snag."

    I thought I saw something about technical faults being challenged and am wondering if I can re-submit this claim?

    Very sorry if this is an obvious question - I have tried looking but there is so much info here. Any help would be greatly appreciated.

    If it was a claim with the airline only then yes. If it was a court claim then probably not.

  • Just a quick update; I have e-mailed Warsaw Chopin to see if they can confirm a bird strike on my flight. Will wait and see if anything comes back
  • Apologies if I am not posting in the correct thread but couldn't find anything that fitted.

    After reading an MSE post last year I decided to put in a claim with SWISS (Aug 2013) for a delay we had suffered in 2009, returning from Venice.
    I still had all the supporting documents and could prove that our flight had landed over 3 hours later than scheduled.

    I emailed SWISS on 16/08, by 19/09 I received a reply blaming the delay on a "technical problem". This however is not a sufficient reason (not an extraordinary and unavoidable circumstance) to dismiss my claim, so I persevered. SWISS wasn't having any of it...

    I then contacted the Federal Office of Civil Aviation (FOCA) based in Switzerland (PassengerRights@bazl.admin.ch) who replied that they were only competent for flights departing from an airport in Switzerland, but that a violation of the "rules" could not be ruled out.

    FOCA then referred my complaint to ENAC (L'Ente Nazionale per l'Aviazione Civile) in Rome. This happened on 5th December 2013.

    On 9th January 2013, I received an email from ENAC Rome to explain that they had forwarded the case to the Venice ENAC office.

    Loads of email ping pong ensued, just trying to figure out who to communicate with actually.

    On 13th May 2014, I finally received an email from the Airport Director at Venice Airport. The official scanned document explained that the Airport Managers journals are only held for two years. "we would not be able to ascertain for the flight in question a possible breach of community law, therefore we consider your case closed"...

    I then logged a complaint with the Passengers' Rights Team at EUROPE DIRECT Contact Centre (European Union).
    The aforementioned Commission however "has no power of redress"...

    So I basically am nowhere now!

    Any tips on what to do next? Any suggestions would be welcome.

    Unfortunately it appears like the majority of posters on this forum you have to send Swiss an NBA then commence court action. Hopefully the NBA may force them to realise the error of their ways but if it doesn't do not just use the letter as a threat and mean what you say.

    Your claim is not with FOCA, ENAC, the Venice Airport Director or the Passengers' Rights Team at EUROPE DIRECT. It's with SWISS.

    As 111KAB has said, commence court action. Otherwise hand over to a NWNF or walk away.

    I wonder if someone would be kind enough to help. I am trying to claim compensation for a delayed flight but cannot find details of the flight number or airline.


    We were originally scheduled to fly out of Gatwick on 13/09/2011 at about 7pm to Santorini. The flight was delayed over night, with my wife and I sleeping in the airport. For reasons I do not understand, the flight is not showing on the flight stats website. I have also tried speaking to the travel agent, who has not kept details. In addition, we didn't get email confirmation of the flight details as everything was paper-based i.e. our tickets and confirmation were sent through the post, which I cannot now find.


    Any help you could provide to help trace the flight and airline details would be much appreciated. Thanks

    Without the airline you are going to struggle. The flight may not show on flightstats particularly if a charter flight (ie possibly part of a package holiday).
