Hello. I have recently used a letter from here to emirates in order to claim for a cancelled flight.
we were due to fly from larnaca (eu) to bangkok with a stopover in dubai. Ticket was booked at the same time, flights on the same email confirmation and presented to check in counter where we were given a ticket to dubai (we still have a copy of the booking) We were told after scheduled departure that we would be delayed 24 hours meaning we arrived at dubai 24 hours late and final destination 24 hours late.
Emirates have offered compensation of 400 euros as they say the connecting flight was not from an eu airport. Having read ec 216/2004 it states that the final destination is the destination presented on the ticket at the check in counter.
I believe I am entitled to 600 euros per person. I received quite a rude email whereby the lady told me she was fully conversant with ec legislation and that I was only entitled to 400 euros. Any advice?0 -

can you clarify the actual journey, I assume you were travelling LCA-DXB-BKK but you mention a stopover which normally refers to a break of over 24 hours.
If this was not a stopover and purely a transit (straight off one flight and onto another) then I believe you are correct with €600 based on distance from LCA-BKK
If you were having a stopover in DXB then the €400 is correct0 -

24 Hours delay means a huge delay and most probably it was delayed from its source airport (LCA - eu). And if it was delayed from its source airport then why one cant get compensation of 600 euros each according to eu regulation.0 -

It depends what the poster means by stopover. If for example, you were travelling LCA-DXB and then due to spend 2 nights there before the next flight then the compensation is due on the distance from LCA-DXB, if connecting (without stopover so within 24 hours) then compensation would be due on LCA-BKK distance
Once the poster confirms what they mean by "stopover" the correct answer will be known0 -
I am so grateful for this website. I used the template letter for my claim and admittedly at first Icelandair did give me the brush off but as soon as I mentioned CAA were now involved and I would take them to court they settled straight away for £1,093. This took me 3 weeks in all.
I was due to fly to Iceland on 26 July FI451 and then connect to Toronto on a second plane. The flight was cancelled due to technical fault and we along with everyone else were re-routed onto new flights. We ended up with 26 hr delay and went via British airways the next day and missed a whole day in Toronto. I claimed for compensation of £504 each for canceled flight and then £85 for hotel bill in Toronto where we never stayed.

I just wish I got somewhere with Thomson from a delayed flight in 2011. They have continued to ignore me and now I cannot find my documents I sent them. You win some and lose some!0 -
Thought people might like to know the timing on one successful claim - full details are a couple of pages back.
17 Aug - flight (delayed 6 hours)
23 Aug - submitted claim by letter and email
11 Sept - acknowledgement and acceptance by the airline (as a goodwill gesture and without acknowledging liability) with forms for payment of EUR2,400 (4 passengers)
8 Oct - received EUR1,800 in bank account - chasing the missing EUR600 (I think they simply mislaid one of the four Receipt and Discharge forms)

We flew from Dubai to Kuala Lumpur last week. Halfway into the flight, we hit some bad turbulence and there was a smell in the cabin.
The pilot then made an announcement that the plane had sustained some damage and because the part in question wasnt available in KL they had to turn around back to Dubai. He did say that the plane was perfectly safe and could continue but because of the part unavailability, he couldnt continue. So it seemed more fo a commercial rather than safety issue to me.
We flew back to Dubai and caught another flight 2.5 hrs later. (flight was 7hrs in total).
Grounds for a claim perhaps?0 -
